4-1-13: ELEVATOR EQUIPMENT; INSPECTIONS:
   (A)   Except as may be otherwise provided by this chapter, elevator design, construction, installation, maintenance and operation shall be in accordance with current provisions therefor in the Building Code (as set forth and adopted by reference in this Code) and such equipment shall undergo an inspection and acceptance test by the Director of the Building Department or his designated representative following completion of such construction or installation. The fee for such inspection shall be one hundred fifty dollars ($150.00).
In addition to the elevator permit fee, a plan review fee will be imposed, when applicable, to defray the costs of contracting with independent professionals to review permit applications for compliance with applicable codes.
   (B)   All elevators shall be inspected twice annually, by the Director of the Building Department or his designated representative during the months of February and August of each year. The fee for each biannual inspection shall be seventy five dollars ($75.00). Additional periodic testing of said elevators may be required by the Director of the Building Department or his designated representative following an inspection; which tests shall be made as provided in the Building Code at a fee of seventy five dollars ($75.00).
   (C)   The Director of the Building Department shall issue a certificate of compliance to each elevator which has satisfactorily met all inspections and tests required by this section and the Building Code, and said current certificate shall be posted by the owner in a conspicuous place available to said Director.
   (D)   It shall be unlawful to operate and maintain any elevator in this Village which has not complied with the provisions of this section.
   (E)   Failure of any elevator to comply with the Building Code and Village Code requirements at the time of any biannual or other inspection of the elevator(s) and to thereby qualify for a certificate of compliance for such elevator(s) shall result in the elevator being shut down as provided below:
      1.   If the elevator passes the biannual inspection, the Village shall issue a certificate of compliance to the property owner within thirty (30) days of the Village's receipt of the inspection report evidencing compliance. Such certificate shall be valid for a period of six (6) months, provided that the elevator remains in compliance with all applicable codes.
      2.   If the elevator fails any inspection, the owner shall be notified of the specific violations ("notice") and be given thirty (30) days to correct the said violations, during which time the elevator shall not be used and shall be posted with a stop order issued by the Village Manager or his or her designee as provided in section 2-7-3 of this Code, if the conditions that caused the noncompliance are life threatening in the determination of the Director of the Building Department as stated in the notice. At the end of the thirty (30) day period, the elevator shall again be inspected. If the violating conditions have been corrected, subsection (E)1 of this section shall apply. If the elevator remains in noncompliance, no certificate shall be issued, or if one has been issued, such certificate shall be suspended, and the elevator shall be shut down pursuant to a stop order issued by the Village Manager or his or her designee as provided in section 2-7-3 of this Code, which stop order shall be posted in a prominent place on the elevator until the conditions causing noncompliance have been corrected.
      3.   For all special inspections necessitated by owner's noncompliance, owner shall pay a reinspection fee of seventy five dollars ($75.00) in addition to the biannual inspection fees. Failure of owner to pay any and all inspection fees shall be deemed a violation of the terms of the certificate of compliance and shall subject the owner to revocation of the certificate of compliance following written notice to owner and an opportunity to be heard.
