3-1-12: MOBILE FOOD UNITS:
   (A)   A "mobile food unit" is any vehicle, including a cart, designed to store and carry food for direct sales from the truck or other vehicle to the public for consumption, provided that units for the direct sales of ice cream and other frozen dessert products, commonly known as ice cream trucks, shall be strictly prohibited from operating in the Village, except pursuant to special permit for Village sponsored or approved special events.
   (B)   It shall be unlawful for any person to use or permit the use of any mobile food unit within the Village without having first obtained a license or permit from the Village as required by this Code, nor shall any person use or permit the use of any mobile food unit within the Village in violation of this section or in violation of the provisions of title 7 of this Code pertaining to food service and food sanitation, or inconsistent with the provisions of section 6-1-22 of this Code pertaining to peddlers. Where a conflict exists between any provision in this section and title 7 of this Code, food service and retail food establishment regulations, the title 7 regulations shall apply.
   (C)   Mobile food units shall be kept in a clean and sanitary condition.
   (D)   It is unlawful to permit stale food, decaying matter or any other waste material or product to accumulate in or on any mobile food unit while it is used for such vending purposes.
   (E)   If unwrapped foodstuffs are carried on the mobile food unit for sale to the public, such goods shall be carried in a compartment or section of the vehicle, which is screened or otherwise protected from dirt and insects.
   (F)   If perishable food is carried on the mobile food unit for sale to the public, such food shall be carried only within properly maintained and refrigerated or heated receptacles.
   (G)   It is the duty of the Health Officer to make, or cause to be made, such inspections as may be necessary to ensure compliance with this section and with the health and sanitation provisions of this Code pertaining to food service and food establishments.
   (H)   It is unlawful for any person to use or permit the use of any mobile food unit within the Village unless a license or permit has first been obtained.
   (I)   Any person desiring a license or permit as required in this section or by this Code shall file an application therefor with the Village Clerk. Such application shall cite the name, address of and contact information for the owner of the vehicle or vehicles in question, the nature of the goods carried on the vehicle, and the name, address of and contact information for the owner of the business if different from the owner of the vehicle(s).
