8-5-11: CLASSIFICATION OF LOCAL LIQUOR LICENSES:
Such local liquor licenses shall be, and are hereby, divided into the following classes:
   A.   Class 1 - Restaurant Alcoholic Liquor For Consumption On Premises: A Class 1 local liquor license shall authorize the sale in restaurants of alcoholic liquor for consumption only on the restaurant premises.
   B.   Class 2 - Restaurant Beer And Wine For Consumption On Premises: A Class 2 local liquor license shall authorize the sale in restaurants only of beer and wine for consumption on the restaurant premises.
   C.   Class 3 - Hotel Alcoholic Liquor For Consumption On Premises: A Class 3 local liquor license shall authorize the sale of alcoholic liquor for consumption only on the hotel premises. (Ord. 3428, 5-14-2012)
   D.   Class 4 - Package Alcoholic Liquor: A Class 4 local liquor license shall authorize the sale, on the premises specified in the license, of alcoholic liquor for consumption not on the premises ("package sales"). Package sales shall be limited to premises primarily devoted to the sale at retail of grocery food, commonly known as supermarkets, and pharmaceuticals and sundries, commonly known as pharmacies, if the pharmacy is operated in conjunction, and shares a common entrance with, a supermarket, both totally consisting of not less than fourteen thousand gross above grade square feet, subject to the following conditions and restrictions:
      1.   That portion or portions of the premises devoted to the sale of alcoholic liquor shall be no larger than ten percent of the gross above grade square feet of the entire premises which is the subject of the application and license.
      2.   Although the sale of alcoholic liquor may take place at all cash registers within the premises subject to the license, no sale shall be made or accepted by a cashier or other employee under the age of twenty one years of age, and appropriate signage shall be posted by the licensee at all cash registers reminding customers that alcoholic liquor cannot be purchased by anyone under the age of twenty one years of age.
      3.   Alcoholic liquor and beer shall only be sold in original containers. Original containers of alcoholic liquor and beer shall not be opened and/or poured prior to sale, except as permitted for tasting purposes in subsection D4 of this section. Original containers of beer may be sold individually, even if the original containers of beer are distributed in packages of four original containers, six original containers, or other similar packaging.
      4.   Sampling and/or tasting of the products being sold may be allowed under the following restrictions:
         a.   The administration of such sampling and/or tasting and the actual serving shall be done only by a department manager of the licensee or his/her superiors.
         b.   The sampling and/or tasting may not be offered more than two times a week and shall not exceed six hours for each day of such sampling and/or tasting.
         c.   Sampling and/or tasting must occur in a single designated location; multiple locations are prohibited.
         d.   Up to three samples, consisting of no more than: 1) one- fourth ounce of distilled spirits, 2) one ounce of wine, or 3) two ounces of beer may be served to a consumer in one day.
      5.   A Class 4 license may not be issued to both the supermarket and drugstore within the premises; rather, the license may be issued to either the supermarket or drugstore, but not both.
      6.   That portion of the premises devoted to the sale of alcoholic liquor shall not have ingress and egress separate from the ingress and egress of the nonalcoholic portions of the premises. (Ord. 3789, 12-9-2019)
   E.   Class 4A - Package Beer And Wine: A Class 4A local liquor license shall authorize the sale, on the premises specified on the license, of only beer and wine for consumption not on the premises ("special package sales"). Such special package sales shall be limited to premises primarily devoted to the sale at retail of grocery food, commonly known as supermarkets, consisting of not less than fourteen thousand gross above grade square feet. Such sale of beer and wine shall be subject to the following conditions and restrictions:
      1.   Beer and wine shall only be sold in original containers. Original containers of beer and wine shall not be opened and/or poured prior to sale, except as permitted for tasting purposes in subsection E2 of this section. Original containers of beer may be sold individually, even if the original containers of beer are distributed in packages of four original containers, six original containers, or other similar packaging.
      2.   Sampling and/or tasting of the products being sold may be allowed under the following restrictions:
         a.   The administration of such sampling and/or tasting and the actual serving shall be done only by a department manager of the licensee or his or her superiors.
         b.   The sampling and/or tasting may not be offered more than two times a week and shall not exceed six hours for each day of such sampling and/or tasting.
         c.   Sampling and/or tasting must occur in a single designated location; multiple locations are prohibited.
         d.   Up to three samples, consisting of no more than: 1) one- fourth ounce of distilled spirits, 2) one ounce of wine, or 3) two ounces of beer may be served to a consumer in one day.
      3.   Although the portion of the premises devoted to the sale of the beer and wine need not be confined to an area which is separated from the other retail portions of the premises, the portion of the premises devoted to the sale of such beer and wine shall be no larger than ten percent of the gross above grade square feet of the entire premises which is the subject of the application and license.
      4.   Although the sale of beer and wine may take place at all cash registers within the premises subject to the license, no sale shall be made or accepted by a cashier or other employee under the age of twenty one years of age, and appropriate signage shall be posted by the licensee at all cash registers reminding customers that beer and wine cannot be purchased by anyone under the age of twenty one years of age.    F.   Class 4B - Restaurant Package Alcoholic Liquor: A Class 4B local liquor license shall authorize the sale, on the premises specified on the license, of alcoholic liquor for consumption not on the premises ("restaurant package sales"). Such sale of alcoholic liquor shall be subject to the following conditions and restrictions:
      1.   Alcoholic liquor may only be sold in conjunction with the sale of prepared fresh food.
      2.   There shall be no breakdown of any retail packaging from the original manufacturer or wholesaler into smaller packaging or individual containers.
      3.   Beer and/or wine may be sold only in containers between twelve ounces and fifty ounces in size.
      4.   Alcohol liquor, other than beer or wine, may only be sold in containers between twelve ounces and twenty six ounces in size.
      5.   The sale of unmixed alcohol liquor, other than beer or wine, is prohibited.
      6.   Sampling and/or tasting of any alcoholic liquor is prohibited. (Ord. 3428, 5-14-2012)
   G.   Class 5 - Temporary Special Event Alcoholic Liquor: A Class 5 local liquor license ("temporary license") shall authorize the sale of alcoholic liquor at a special event sponsored by an applicant. A temporary license shall be limited to: 1) no more than fifteen special events within any one calendar year by an applicant that is a not for profit organization, and 2) no more than fifteen special events within any one calendar year by any applicant other than a not for profit organization. A separate temporary license shall be required for each day of each special event, as each day of an event shall be considered a separate special event. The license shall authorize the sale of alcoholic liquor only between the hours of eleven o'clock A.M. and one thirty o'clock A.M., and the extension beyond twelve o'clock midnight to one thirty o'clock A.M. shall not constitute a new day. Such sales shall take place only in enclosed structures (including tents), but consumption may take place in the open air on property owned or leased by the applicant holding the temporary license.    H.   Class 6 - Restaurant BYOB Beer And Wine: A Class 6 local liquor license shall authorize the restaurants that do not sell alcoholic beverages to permit consumption of beer or wine only brought onto the premises of a restaurant by an adult patron for personal consumption, including consumption by their adult dining guest(s), while the patron and dining guest(s) are being served a complete meal in the restaurant, subject to all of the following conditions and restrictions:
      1.   Consumption of beer and wine is restricted to the licensed premises.
      2.   The restaurant may charge a corkage fee to the patron.
      3.   The sale of beer, wine, spirits and all other types of alcoholic liquor beverages to patrons of the licensed premises shall be prohibited.
      4.   No package sales shall be permitted. The sale of beer, wine, spirits or other alcoholic beverages (e.g., wine coolers, spirits, prepared mixed drinks, etc.) in single cans or bottles, kegs or pitchers or any other form is prohibited.
      5.   Patrons are prohibited from taking any opened alcoholic beverage outside of the premises, except for a recorked wine bottle that has been sealed in a carryout bag in accordance with State law 1 . (Ord. 3428, 5-14-2012)
