7-2-9: HAZARDOUS MATERIALS RESPONSE AND CONTROL:
   A.   Hazardous Materials Defined: "Hazardous materials" means any material or mixture of substance that is toxic, corrosive, flammable, combustible, an irritant, asphyxiant, a strong sensitizer, or that generates pressure through decomposition, heat or other means and that may cause substantial personal injury, illness or property damage during customary or reasonably anticipated handling or use, or may cause an unreasonable threat of damage to property, the public health or safety, or the ecological balance of the environment. "Hazardous materials" includes, but is not limited to, explosives, radioactive substances, petroleum or petroleum products, poisons, toxic gases, flammable substances, corrosive substances and pathogens.
   B.   Deposits Prohibited: No person, firm, corporation or entity shall place, spill, or otherwise deposit, or cause or permit to be placed, spilled or otherwise deposited, any hazardous materials on any property within the village of River Forest or in any building, facility or right of way owned by the village of River Forest, without securing, in advance, proper authorization therefor from the village of River Forest.
   C.   Abatement: The fire chief, or authorized representative, shall cause any unauthorized deposit of hazardous materials to be immediately removed.
   D.   Cost Of Abatement: Any person, firm, corporation or entity which causes or permits to cause any unauthorized deposit, placement or spill of any hazardous materials shall pay to the village of River Forest all costs of abatement, mitigation and removal thereof, including all payments made by the village of River Forest to third parties for services rendered in connection therewith and for supplies and the use of equipment used in connection therewith. These costs shall be paid within thirty days of the mailing or the delivery of an invoice therefor.
   E.   Penalty: Every person found guilty of violating this section shall be guilty of a petty offense or a misdemeanor and be punished by a fine of not less than one hundred dollars nor more than one thousand dollars for each offense. (Ord. 3201, 7-23-2007)
