7-2-8: SMOKING PROHIBITED IN CERTAIN PLACES:
It is hereby found and declared that public elevators and large retail stores where merchandise is displayed and offered for sale attract crowds within relatively small areas, and that smoking in such places is a menace to public health, safety and property. It is unlawful for any person to smoke or carry a lighted cigarette, cigar or pipe in any public elevator or in any retail store in which more than fifteen persons are employed, or in any gasoline service station, excluding areas set apart for serving food or beverages, waiting and rest rooms, executive offices, beauty parlors, and other rooms or areas where merchandise is not exposed.
Every person found guilty of violating this section shall be guilty of a misdemeanor and shall be punished by a fine of not less than ten dollars nor more than five hundred dollars for each offense. (1981 Code)
