4-17-16: HAZARDS; ACCESS; VARIANCE:
   A.   Contractor shall be solely responsible for the determinations and implementation of the means and methods of construction, as well as compliance with all applicable workplace safety rules, regulations, or guidelines. Notwithstanding any permitting under this Chapter, whenever the Director of Public Works and Development Services determines that any existing excavation, embankment, fill, or land contour on private property is a health hazard or adversely affects the safety, use or stability of a public way or drainage channel, the owner of said property shall, upon receipt of written notice from the Director of Public Works and Development Services and within the period specified therein, abate or eliminate any such hazard as requested by the Director of Public Works and Development Services. The Village shall have the right to abate any hazard related to the activities regulated by this Chapter and to charge the applicant for all related costs.
   B.   Representatives of the Village may, at all reasonable times during regular business hours or upon notice, request entry upon any development subject to this Chapter for the purpose of conducting periodic inspections to ensure compliance with this Chapter and/or a grading permit issued thereunder. The scope of the inspection, including reviewing and copying of records, is limited to determining whether the development is in compliance with all requirements and conditions of this Chapter and/or a grading permit. The Village may periodically request entry to inspect any mitigation measure at reasonable times and such inspection shall be limited to determining whether the development is in compliance with all requirements and conditions of this Chapter and/or a grading permit. If a request for entry is denied, the Village may seek to obtain and execute a search warrant pursuant to Chapter 4-14 of the Village Code.
   C.   The Village may grant variances from the requirements of this Chapter pursuant to Section 4-13-7 of the Village Code. (Ord. 3877, 11-14-2022)
