3-6-3: USE OF PUBLIC SIDEWALKS; SPECIAL LICENSE REQUIRED:
No person shall maintain floral displays on a public sidewalk without first having obtained a special license therefor. Such special license shall be issued for one year, ending on March 31. The special license fee shall be as set out in Section 3-2-3 of this Code. This special license shall be required in addition to a regular business license. Such special license shall be subject to the following provisions:
   A.   Open Sidewalk: It shall be unlawful for the open portion of any sidewalk to be reduced to less than five feet in width.
   B.   Maintenance Of Sidewalk: It shall be unlawful to maintain the sidewalk area in an unclean or unsafe condition.
   C.   Application: Every person who desires a special license for floral displays on a public sidewalk shall make application in writing to the Village Clerk stating:
      1.   The name of the applicant;
      2.   The name of the business;
      3.   The address of the business;
      4.   The telephone number of the business;
      5.   A diagram of the sidewalk area to be used which specifies the area dimensions;
      6.   Evidence of public liability insurance including the Village as a party insured and insuring the Village against any liability resulting from the uses permitted pursuant to this Section. The coverage shall not be less than one million dollars per occurrence;
      7.   A signed hold harmless and indemnification agreement the text of which shall be determined by the Village.
   D.   Application Review: The application for special license shall be reviewed by the Director of Public Works and no special license shall be issued unless the Director of Public Works reports that the proposed use will not unreasonably interfere with pedestrian or vehicular traffic.
