§ 35.25 ARP CORONAVIRUS LOCAL FISCAL RECOVERY FUND.
   (A)   Pursuant to State Examiner Directive 2021-1, the Common Council of the City of Rising Sun, Indiana does hereby create Fund Number [176 to 199], which is a special, non-reverting fund that is designated as the ARP Coronavirus Local Fiscal Recovery Fund.
   (B)   The purpose of the funds is to be used for only the following reasons as set forth in Section 603(c) of the Social Security Act as added by Section 9901 of the ARP in accordance with guidance issued by the United States Treasury and the Indiana State Board of Accounts:
      (1)   To respond to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19) or its negative economic impacts, including assistance to households, small businesses, and non-profits, or aid to impacted industries such as tourism, travel, and hospitality;
      (2)   To respond to workers performing essential work during the COVID-19 public health emergency by providing premium pay to eligible workers of the City of Rising Sun that are performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work;
      (3)   For the provision of government services to the extent of the reduction in revenue of the City of Rising Sun due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year of the City of Rising Sun prior to the public health emergency;
      (4)   To make necessary investments in water, sewer, or broadband infrastructure; and/or
      (5)   Funds made available may be transferred to a private non-profit organization (as that term is defined in Paragraph 17 of Section 401 of the McKinney-Vento Homeless Assistance Act - 42 U.S.C. 11360(17)), a public benefit corporation involved in the transportation of passengers or cargo, or a special purpose unit of state or local government.
   (C)   Any funds to be expended shall be appropriated by the Common Council of the City of Rising Sun, Indiana prior to expenditure.
   (D)   All expenditures of funds shall be approved by the Common Council of the City of Rising Sun, Indiana with any and all claims to be paid from the City of Rising Sun's ARP Coronavirus Local Fiscal Recovery Fund.
   (E)   The Common Council of the City of Rising Sun, Indiana will establish a plan which will outline the conditions and rules upon which the funds in the ARP Coronavirus Local Fiscal Recovery Fund are to be requested and used.
   (F)   Any unused funds shall be paid back to the United States Treasury if so required.
   (G)   The Clerk-Treasurer of the City of Rising Sun, Indiana shall keep accurate and complete financial records of the receipt and expenditure of any and all funds deposited and paid from the ARP Coronavirus Local Fiscal Recovery Fund. The Clerk-Treasurer of the City of Rising Sun, Indiana may retain the professional services of a third party or company to assist with this accounting upon the appropriation of necessary funds and the approval of any contracts by the Common Council of the City of Rising Sun, Indiana.
   (H)   No money received in the ARP Coronavirus Local Fiscal Recovery Fund shall be used for any type of deposit into any pension fund.
   (I)   The funds shall be used only in accordance with the plan as established by the Common Council of the City of Rising Sun, Indiana which is attached to Ordinance 2021-5 as Exhibit "A", which is adopted by reference as if set out in full herein, and which may be modified from time to time.
