§ 114.01 APPLICATION OF CHAPTER.

(A) This chapter shall apply to any yard sale, garage sale, flea market, and the like regardless of whether the sale takes place on a residential property or a business property.

(B) Any yard sale, garage sale, flea market, and the like that violates this chapter shall be deemed a nuisance and shall be sent to the City Attorney to file the appropriate civil proceedings.

(C) The property owner and/or occupant shall be responsible for any fines assessed pursuant to § 114.02(A)(6) and/or § 114.03(E) as well as costs associated with bringing the civil proceedings.
