§ 73.99 PENALTY.
   (A)   All penalties for violations of §§ 73.02 through 73.05 shall be treated under § 10.99 of the Rising Sun Municipal Code which states "any person, firm or corporation who violates ... shall, upon conviction, be subject to a fine not exceeding $2,500.00."
   (B)   Any person violating any provision of §§ 73.02 through 73.05 shall be punished by a fine for the first offense of not less than $25. For the second offense, not less than $50. If a third offense is committed within one year of conviction of a second offense, the minimum fine shall be $100 and the owner's registration shall be revoked. If a registration is revoked, the owner shall pay a re-registration fee of $200. The registered owner or family member cannot thereafter register a motorized cart for use in the city for a period of two years following a third conviction.
   (C)   A further violation of this chapter may be subject to a fine as set forth in this chapter and subject to prosecution in an Ohio County Court of Law.
   (D)   (1)   Any person found in violation of §§ 73.20 through 73.24 may be fined $15 for a first offense, and $25 for a second offense. Any person committing a third or subsequent violation of §§ 73.20 through 73.24 may be liable for a fine of up to $500.
      (2)   Furthermore, whoever shall violate any provision of §§ 73.20 through 73.24 may have the skateboard confiscated immediately by any law enforcement officer acting in his or her official capacity. If a minor (a person under the age of 18) is cited for a violation of §§ 73.20 through 73.24, the police officer citing the offender may take possession of the skateboard, roller skates, in-line skates, coaster, scooter, toy vehicle or other similar equipment and secure it until the ordinance violation is resolved or the parent or guardian of the minor appears at police headquarters and requests its return, whichever occurs first. If a person over the age of 18 is cited for a violation, the device confiscated shall be held for a maximum of 60 days, after which it may be sold at auction or destroyed. The individual who owns any such confiscated device shall have the right to repossess the device upon proof of payment of any fine and other costs for which the individual is responsible as a result of the violation.
