303.99  PENALTY.
   (a)   General Penalty.  Whoever violates any provision of this Traffic Code for which another penalty is not provided shall, for a first conviction thereof, be fined not more than one hundred dollars ($100.00) or imprisoned not more than ten days, or both; for a second such conviction within one year(s) thereafter such person shall be fined not more than two hundred dollars ($200.00) or imprisoned not more than twenty days, or both; and upon a third or subsequent conviction within one year(s) thereafter, such person shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than thirty days, or both.  In order for a person to be convicted of a third or subsequent offense, it shall not be a prerequisite that his second such conviction be formally classified as a “second offense” conviction.  Rather, in order for a person to be convicted of a third or subsequent offense, it shall be sufficient that said person have two prior convictions occurring within two years of his arrest or citation for a third or subsequent offense.  (9-16-03)
 
   (b)   Parking Fines Generally.

   (c)   Overtime Parking.
      (1)   Metered parking areas and spaces.
         A.   The fine for any vehicle violating the overtime parking provisions in a designated paid or metered parking space shall be five dollars ($5.00) if the fine is paid within the first twenty-four hours following the issuance of the citation for said offense.  (2-4-20)
         B.   The fine for any vehicle violating the overtime parking provisions in a metered parking area or metered parking space, if paid after the expiration of the first twenty-four hours set forth in subsection (c)(1)A. hereof, shall be ten dollars ($10.00).
         C.   A vehicle may be issued as many as two (2), but no more than two (2) citations for violating the overtime parking provisions in a metered parking area or metered parking space within any continuous period from 8:00 a.m. to 5:00 p.m. on any one day.
         D.   In the event that a vehicle is issued a second citation for violating the overtime parking provisions in a metered parking area or metered parking space within any continuous period from 8:00 a.m. to 5:00 p.m. on any one day, then notwithstanding the fine provisions set forth above, the fine for any such second citation shall be ten dollars ($10.00) if the fine is paid within the first twenty-four hours following issuance of the citation for said offense.  The fine for a second citation for violating the overtime parking provisions in a metered parking area or metered parking space, if paid after the expiration of the first twenty-four hours set forth in this paragraph shall be twenty-five dollars ($25.00).
         E.   In the event that the same such vehicle violates the overtime parking provisions in a metered parking area or metered parking space by remaining parked at the same space for twenty-four hours after the issuance of any overtime parking citation, then in addition to the penalties provided by subsections (c)(1)A., B., C. and D. hereof, the Ripley Police Department and its officers are directed and authorized to cause the said vehicle to be removed from the restricted parking space, at the expense of the operator of the vehicle.
      (2)   Ripley Municipal Parking Lot.
         A.   The fine for any vehicle violating the marked and designated maximum continuous parking limit of twenty-four continuous hours at marked and designated spaces in and within the Ripley Municipal Parking Lot, shall be twenty-five dollars ($25.00);
         B.   The fine for the same vehicle violating the marked and designated maximum continuous parking limit of twenty-four hours at marked and designated restricted parking spaces by remaining parked within the Ripley Municipal Parking Lot for an additional twenty-four hour continuous period (a total continuous period of forty-eight hours), shall be fifty dollars ($50.00) which shall be in addition to the penalty provided by subsection (c)(2)A. hereof;
         C.   In the event of any vehicle violating the marked and designated maximum continuous parking limit of twenty-four hours at marked and designated restricted parking spaces by remaining parked within the Ripley Municipal Parking Lot for an additional twenty-four hour continuous period (a total of seventy-two hours), in addition to liability for all of the fines set forth in this subsection, such vehicle shall be removed from the Ripley Municipal Parking Lot, at the expense of the vehicle owner or operator.
