(a) All persons qualified to serve as petit jurors under the provisions of West Virginia Code, Chapter 52, Article 1 shall be qualified to serve as petit jurors in Municipal Court.
(b) When a jury trial is to be held in Municipal Court, the Clerk of the Municipal Court shall submit to the Circuit Clerk of Jackson County, a written request that said Circuit Clerk certify a list of jurors from the panel of jurors selected to serve on circuit court petit juries, and the number of jurors requested.
(c) The list of qualified jurors provided by the Circuit Clerk shall include a legible copy of the qualification questionnaire completed by each such juror incident to his or her qualification to serve as a juror.
(d) If a jury is to be drawn for a trial in Municipal Court, the Municipal Clerk shall cause each person named on the list provided by the Circuit Clerk to be notified not less than twenty (20) days before the date on which such persons are to report for jury duty with a summons, by personal service or first class mail addressed to the person at his or her usual residence, business or post office address, requiring him or her to report for jury service at a specified time and place.
(e) A prospective juror who fails to appear as directed by the summons issued pursuant to subsection (d) above shall be ordered by the Municipal Court to appear and show cause for failure to appear as directed. If the prospective juror fails to appear pursuant to the court’s order or fails to show good cause for failure to appear as directed by the summons, he or she is guilty of civil contempt and shall be fined not more than two hundred dollars ($200.00).
