Any defendant in any criminal action, a conviction for which carries with it the possibility of any incarceration, shall be entitled to a trial by jury, and any such verdict shall be unanimous. Any defendant in jeopardy of incarceration may waive his right to a jury trial, if he is advised of his right to a jury trial and affirmatively executes such waiver in writing.
