127.01 COMPOSITION; SPECIAL POLICE; COMPENSATION.
   (a)    The police force of the City shall consist of a Chief and such number of patrolmen authorized by resolution of Council, who shall be appointed by the Mayor with the approval of Council and who may be suspended by the Mayor until the next regular meeting of Council who
shall have the sole authority to discharge police.
   (b)    The members of the police force shall receive and promptly obey all lawful orders of the Mayor and Chief of Police. The Mayor may appoint special policemen when the need therefor arises.
   (c)    The salary of the police shall be fixed by Council. Special police shall be paid for their services such sum per day as the Mayor in his order of appointment shall designate.
   (d)    When special police are appointed by the Mayor, they shall be under his immediate control unless he shall place them under the control of the Chief of Police.

127.02 POWERS AND DUTIES.
   (a)    It shall be the duty of the police to carry out all orders of the Mayor, enforce all ordinances of the City, and do whatever is necessary for the general welfare of the City.
   (b)    The Chief of Police and any member of the Police Department of the City shall have all the powers, rights and privileges within the corporate limits of the City to arrest persons, to collect claims and to execute and return any search warrant, warrant of arrest or any other process than can legally be exercised by a constable within a district within the county.
   (c)    Each police officer shall have the power to arrest for violation of municipal ordinances and for the violation of all state laws or matters arising within the corporate limits and coming within the scope of his official duty. The power of the police shall extend anywhere within the county in which the City is situated.
   (d)    The Chief of Police or any member of the Police Department shall have the power to make and arrest for any offense committed in his presence without a warrant and to take the person arrested before the Mayor or other police court to be dealt with according to law.

127.03 BOND.
   All members of the Police Department shall, before entering upon the duties of their office, execute a bond according to law with security satisfactory to Council, payable to the City in such penalty not to be less than three thousand five hundred dollars ($3,500) as Council may prescribe.

127.04 OATH.
   Each police officer shall take the following oath before entering upon the duties of his office:
 
   I,                                        , do solemnly swear that I will support the Constitution of the United States of America, the Constitution of the State of West Virginia, and that I will truly and faithfully and impartially discharge the duties of policeman of the City of Ripley to the best of my ability, so help me God.

127.05 EMPLOYMENT AGREEMENT.
   CITY OF RIPLEY POLICE DEPARTMENT EMPLOYMENT AGREEMENT
   THIS EMPLOYMENT AGREEMENT, entered into this                      day of                                         , _____________by and between the Ripley Police Department (hereinafter "the Department") and                                        (hereinafter "the officer").
   Whereas, the Department agrees to hire the officer as a member of the Ripley Police Department and to pay the expenses incurred for the officer's attendance and training at the West Virginia State Police Academy (hereafter "the Academy") and;
   Whereas, during this period of time in which the officer attends the Academy, the Department shall pay compensation to the officer, including his regular wages or salary, benefits, tuition and expenses for the employee's attendance at the Academy. The compensation paid to the officer for attendance at the Academy shall not include overtime compensation but shall be at the regular rate to which the officer would be entitled for a workweek of forty hours in regular employment with the Department.
   In consideration for such compensation, the officer agrees that, if the officer should voluntarily discontinue employment any time within one year immediately following completion of the training curriculum at the Academy, he or she shall repay to the Department a pro rata portion of the sum of such compensation equal to that part of such year which the officer has chosen not to remain in the employ of the Department, which payment shall be made no later than three (3) months following the officer's last date of employment with the Department. The Department shall notify the officer in writing of the sum to be repaid within two (2) weeks of the officer's last day of employment with the Department.
