(a) From time to time the City may receive a request from a private person, business entity or other government agency that the City provide services to that private person, business entity or government agency which make particular use of the special skill, talents or abilities of City law enforcement employees acting in their official capacity as police officers of the City of Ripley. Such requests shall be made in writing to the Mayor of Ripley and shall include the following:
(1) A description of the service requested;
(2) The period of time during which the service is requested;
(3) The rate of pay the requesting entity proposes to pay the City for the employee’s services.
(b) The City Council shall approve or disapprove each such request at its regular meetings. No such request shall be approved if the terms of said request conflict with any other City ordinance, except as otherwise provided herein.
(c) If the Council approves such request for services by a City law enforcement employee, the Council may, at its option, enter into a contract with the requesting person or entity reflecting the parties’ employment agreement. If such request is approved, the law enforcement employee shall be assigned to perform the agreed-upon service or duty by the Chief of Police.
(d) In the event that an emergency arises which requires the law enforcement employee to return to his regular duties for the City, such emergency shall supersede any contract or agreement between the City and the requesting entity. The requesting entity shall have a pro rata portion of its payment for the employee’s service refunded for the period of time which the employee spent responding to said emergency.
(e) Notwithstanding the provisions set forth above, the Council may approve a rate of pay for the City employee which exceeds the employee’s regular rate of pay, overtime pay or holiday pay as otherwise set forth in the City’s ordinances. Council may require that the requesting entity pay all additional expenses incurred by the City, which are incidental to the employee’s compensation, including but not limited to matching Social Security contributions, unemployment contributions, Worker’s Compensation contributions, retirement contributions, and similar expenses incurred by the City.
(f) Upon adoption of this section, the Council may retroactively approve a rate of pay which is consistent with this section for any City law enforcement employee which has performed a special assignment within thirty (30) days prior to the effective date of this section.
(g) In the event that the Council approves a request for services which includes the use of City equipment, the Council may set a rate or fee at which the City is reimbursed for the use of said equipment.
