1723.06 AWNING REQUIREMENTS; PERMIT; FEE.
   No person shall erect, set up, place, retain or maintain any permanent awning or covering extending over any street, alley, sidewalk or public place in the City without having obtained permission from the City to do so as hereinafter provided.
   Every awning or covering so erected shall be erected in accordance with plans approved by the City Engineer or Building Inspector and shall remain at the pleasure of the City.

   Any person desiring to erect, set up, place, retain or maintain such awning or covering on or over any such public place shall file before Council a petition in writing signed by the petitioner, in which shall be stated the kind, height above ground, dimensions and specifications of the awning or covering desired to be erected, set up, placed, retained or maintained; that the petitioner shall keep such awning or covering in good order and repair or that such awning or covering will be removed at any time the City shall so direct; that the petitioner will erect, set up, place, retain and maintain such awning or covering subject to all the provisions of this section; and further, if the petition is granted by Council, the petitioner will pay to the City a permit fee based upon the building permit fee.
