If the Building Enforcement Agency so prescribes, no unfit dwelling or other building shall be occupied or used for any purpose after the service of notice upon the owner or owners, as provided for, until the instructions of the Building Enforcement Agency have been complied with, rescinded or set aside. However, any owner or owners shall have the right to apply to the Circuit Court of Jackson County for a temporary injunction restraining the Building Enforcement Agency pending final disposition of the case.
In the event such application is made, a hearing thereon shall be had within twenty days, or as soon thereafter as possible, and the Court shall enter such final order or decree as the law and justice may require. Costs shall be imposed in such manner as in the discretion of the Court shall seem meet and proper.
