(a) No secondhand dealer shall purchase any article of secondhand property from a minor except with the written consent of the minor's parent or guardian, which consent must be signed in the presence of the secondhand dealer. The written consent shall be included in the record required under Section 818.06 of this chapter.
(b) No secondhand dealer shall keep, maintain or conduct a place for the purchase, reception or storage of stolen goods or any article of secondhand property from any person known to be a thief or to have been convicted of theft or burglary. If any article of property purchased by a secondhand dealer is determined to be stolen and the rightful owner has been identified, then the article property shall be returned to the rightful owner without charge.
(c) No secondhand dealer shall purchase any article of secondhand property from any person who appears intoxicated or under the influence of any drug.
