As used in this chapter:
(a) "Building Inspector" means a full or part-time Village employee whose duties include the inspection or examination of structures in the Village to determine if code violations exist.
(b) "Building owner" means the legal or beneficial owner of a structure.
(c) "Code" means any Village ordinance or law, or any housing or building code, that establishes construction, plumbing, heating, electrical, fire prevention, sanitation or other health and safety standards that are applicable to structures in the Village.
(d) "Hearing Officer" means a Village employee or an officer or agent of the Village, other than a Building Inspector or law enforcement officer, whose duty it is to:
(1) Preside at an administrative hearing called to determine whether or not a code violation exists;
(2) Hear testimony and accept evidence from a Building Inspector, the building owner and all interested parties relevant to the existence of a code violation;
(3) Preserve and authenticate the transcript and record of the hearing and all exhibits and evidence introduced at the hearing;
(4) Issue and sign a written finding, decision and order stating whether a code violation exists; and
(5) Impose penalties, fines, costs and other sanctions, consistent with the applicable provisions of these Codified Ordinances, upon finding an owner liable for a charged violation, and to dismiss the case in the event a violation is not proved.
