1045.03 OPTIONAL CORRECTION PROCEDURES.
   (a)   After the Director of Public Works sends a ninety-day notice to a property owner demanding the correction of his or her illegal connection pursuant to Section 1042.14, he or she shall contact the owner, arrange for such owner to pay to the Village his or her corrective costs or, in the alternative, cause the owner to arrange for a loan at a bank. Such owner's corrective costs shall also include any out of pocket loss prorata incurred by the Village, except staff time.
   (b)   Upon receipt of the owner's estimated costs for corrections, the Village may create a special escrow trust account and arrange for private contractors to bid on the work for the designated area involved. Upon approval of the lowest and responsible bid, the Director shall oversee the work involved under the direction of the Village Manager and pay the contractor in full upon his or her full satisfaction of the completed work.
   (c)   Because an emergency exists and procurement of this special work is unique, the Village Engineer or the Director may solicit bids privately rather than advertise for bids in accordance with customary procedures.
   (d)   Nothing in this section shall preclude any property owner from independently contracting for the correction of illegal connections, and for his or her payment therefor, so long as the installation is approved by the Director and the Village Manager and is timely completed.
   (e)   The Director shall promulgate such rules and regulations as he or she deems necessary to implement these procedures upon concurrence of the Board of Trustees. He or she may send such other follow-up notices to property owners in violation, in addition to the first ninety-day notice, as he or she deems necessary.
   (f)   The Village shall waive any permits or permit fees which may be required to implement these corrections.
   (g)   The Director shall continue in-house inspections and smoke testings with dispatch so as to complete this program, ascertain all Village owners of illegal connections and make frequent reports to the Board so that all corrections are fully completed in accordance with the Village schedule of compliance filed with the Metropolitan Sanitary District of Greater Chicago.
