1024.08 BARRICADES AND WARNING LIGHTS AND DEVICES.
   (a)   Generally. Any person who repairs or constructs any pavement, sewer, public utility line or other work, or who makes any excavation in, upon, under or adjoining any curbing, street, alley, sidewalk or other public ground, whether paved or unpaved, shall, at all times, while such work is being done, comply with the following:
      (1)   The person shall enclose such work for the protection of the same and the public with good, substantial and sufficient barriers, placed under the supervision of the Village Engineer. Such barriers shall be not less than three feet high with at least one red or amber light securely and conspicuously posted in or near the excavation, provided that the obstruction does not extend more than ten feet in length. No barrier shall unnecessarily obstruct traffic. The Engineer shall be the judge of such obstruction.
      (2)   If such obstruction is more than ten feet and less than fifty feet in length, two red or amber lights shall be posted, one at each end. One additional light shall be posted for each additional fifty feet of length or part thereof. Such lights shall be kept burning from sunset of a given day to sunrise of the next day.
      (3)   The person shall place or erect a high level warning device under the direction and supervision of the Engineer for the purpose of warning approaching vehicles of the work site. Such high level warning device shall be a minimum of seven feet in height and extendable to a height that will provide adequate advance warning of the work site. The device shall be equipped with one or more flags, lights, signs or a combination thereof that will warn approaching vehicles under the existing weather conditions and during day or night hours. No high level warning device shall unnecessarily obstruct traffic, and the Engineer shall be the judge of such obstruction.
      (4)   All warning devices, barriers and lights shall be promptly removed on the completion of the work as the Engineer may direct.

   (b)   Contracts. In a contract for paving or grading streets, for constructing sewers, for laying water pipes, for building and repairing bridges and culverts or for doing any other similar work, whereby accidents or injuries may occur in consequence of neglect or carelessness on the part of the contractor, a covenant or condition of the contract shall require the contractor to place and maintain a good and sufficient fence, railing or barrier around the same in such a manner as to prevent accidents and to keep, upon such fence, railing or barrier, suitable and sufficient colored lights during the entire night. The contractor shall also keep and save the Village harmless and indemnified against all loss and damages which may be occasioned by reason of any negligence or carelessness in the manner of doing such work. This section is further conditioned upon compliance with the requirements of the Village Engineer and/or the Director of Public Works. (Adopting Ordinance)
   (c)   Removal; Tampering. No person shall remove any barricade or warning light or device erected in front of or about any defective sidewalk or street in the Village, or in front or about any sidewalk or street under repair or undergoing reconstruction in the Village, or in any way interfere with, change or destroy such barricade or warning device until such sidewalk or street is repaired or rebuilt.
