1024.04 TIME LIMIT FOR OPEN EXCAVATIONS; REFILLING BY ENGINEER.
   (a)   No excavation made into any paved street, alley, sidewalk or other public ground of the Village shall remain open longer than is absolutely necessary, and in no event more than two days, except by special written permission of the Village Engineer.
   (b)   If an excavation remains open for longer than two days and the party making such excavation fails to secure the necessary extension of time, having been notified to refill the same and having failed to do so, such refilling shall be made under the direction of the Engineer at the expense of the party making the excavation.
