888.11 SURCHARGE ON CARRIERS.
   (a)   For purposes of this section, the following definitions shall apply:
      (1)   "Network connection" means the number of voice grade communication channels directly between a subscriber and a telecommunications carrier's public switched network without the intervention of any other telecommunications carrier's switched network which would be required to carry the subscriber's inter-premises traffic.
      (2)   "Telecommunications carrier" means any individual, firm, trust, estate, partnership, association, joint stock company, joint venture, corporation, municipal corporation or political subdivision of the State, or a receiver, trustee, conservator or other representative appointed by order of any court, engaged in the business of transmitting messages by means of electricity.
      (3)   "Transmitting messages" has the meaning given that term in Section 8-11- 2 of the Illinois Municipal Code.
   (b)   There is hereby imposed, pursuant to the authority granted the Village by the Illinois Emergency Telephone System Act (hereinafter "the Act"), a surcharge of eighty cents ($0.80) per month per network connection on telecommunications carriers engaged in the business of transmitting messages by means of electricity originating with the corporate limits of the Village and terminating within the State.
   (c)   The Village shall provide any telecommunications carrier subject to the surcharge with a certified list of those network connections assigned to the Municipality to be exempt from imposition of the surcharge. The certified list may be revised by the Municipality on sixty days prior written notice provided to the telecommunications carriers.
   (d)   In lieu of a telecommunications carrier imposing a three percent accounting and collection charge on its subscribers as permitted under the Act, each telecommunications carrier is hereby authorized and instructed to recover said accounting and collection charge by deducting three percent from the amount of surcharge otherwise due and owing the Village prior to remittance under subsection (e) hereof.
   (e)   The surcharge shall be imposed on the first day of the month following the expiration of thirty days from the date the Village Clerk certifies to any of the telecommunications carriers who are subject to the surcharge that the referendum on this section has passed.
   (f)   Every telecommunications carrier shall remit to the Village Treasurer the amount of surcharge due and owing for each calendar month within thirty days following expiration of each month to which the surcharge applies.
   (g)   Simultaneously with the remittance described in subsection (e) hereof, each telecommunications carrier shall make a return to the Village for the period to which the remittance applies, stating as follows:
      (1)   The name of the telecommunications carrier;
      (2)   The telecommunications carrier's principal place of business;
      (3)   The number of network connections to which the surcharge applies;
      (4)   The amount of surcharge due; and
      (5)   Such other reasonable and related information as the corporate authorities may require.
