868.02 CERTIFICATES OF REGISTRATION.
   (a)   Required. Every person who wishes to engage in commercial soliciting from persons in residences in the Village shall make a written application for a certificate of registration therefor, as provided in this section. Person who wish to engage in noncommercial soliciting are encouraged to make application for a certificate of registration as provided herein.

   (b)   Applications.
      (1)   An application for a certificate of registration shall be made upon a form provided by and filed with the Police Chief. The applicant shall truthfully state in full the information requested on the application, including the following:
         A.   The name of the applicant, the address of his or her present place of residence and the length of his or her residence at such address, his or her business address, if other than the residence address, and his or her Social Security number;
         B.   The address of his or her place of residence during the past three years, if other than the present address;
         C.   The age and marital status of the applicant and, if married, the name of his or her spouse;
         D.   A physical description of the applicant;
         E.   The name and address of the person, firm, corporation or association by whom the applicant is employed or whom he or she represents, and the length of time of such employment or representation;
         F.   The name and address of the applicant's employer during the past three years if other than the present employer;
         G.   A description, sufficient for identification, of the subject matter of the soliciting which the applicant will engage in;
         H.   The period of time for which the certificate is applied for;
         I.   The date or approximate date of the latest previous application for a certificate under this chapter, if any;
         J.   A statement as to whether or not a certificate of registration issued to the applicant under this chapter has ever been revoked;
         K.   A statement as to whether or not the applicant has ever been convicted of a violation of any of the provisions of this chapter or an ordinance of another Illinois municipality regulating soliciting;
         L.   A statement as to whether or not the applicant has ever been convicted of the commission of a felony under the laws of the State or any other state of the United States; and
         M.   Such additional information as the Chief may deem necessary to process the application.
         N.   All statements made by the applicant upon the application or in connection therewith shall be under oath.
         O.   The Chief shall require every applicant to submit to fingerprinting by the Police Department in connection with the application.

   (c)   Issuance; Statement of Expiration Date.
      (1)   When the applicant is found to be duly qualified, the certificate of registration shall be issued forthwith.
      (2)   The certificate of registration shall state the expiration date thereof.

   (d)   Denial.
      (1)   After consideration of the application and all information obtained relative thereto, the Police Chief shall deny the application if the applicant does not possess the qualifications for such certificate required in this section or if the issuance of a certificate of registration to the applicant would not be in accordance with the intent and purpose of this chapter.
      (2)   No certificate of registration shall be issued to any person who has been convicted of the commission of a felony under the laws of the State, any other state or the United States, within five years of the date of the application; to any person who has been convicted of a violation of any of the provisions of this chapter; or to any person whose certificate of registration issued hereunder has previously been revoked as herein provided.
      (3)   Endorsement of the denial of the application shall be made by the Chief on the application.

   (e)   Revocation.
      (1)   A certificate of registration issued under this chapter shall be revoked by the Chief if the holder of the certificate:
         A.   Is convicted of a violation of any of the provisions of this chapter;
         B.   Has made a false material statement in the application or otherwise becomes disqualified for the issuance of a certificate under this chapter;
         C.   Violates an ordinance or a State or Federal Regulation in connection with or subsequent to the issuance of an approved solicitor's certificate of registration; or
         D.   Makes a nuisance of himself or herself to the community or to the Police Department.
      (2)   Immediately upon such revocation, written notice thereof shall be given by the Chief to the holder of the certificate in person or by certified United States mail addressed to his or her residence address as set forth in the application.
      (3)   Immediately upon the giving of such notice, the certificate of registration shall become null and void. (Adopting Ordinance)
   (f)   Records. The Chief shall cause to be kept in his or her office an accurate record of all applications received and acted upon, together with all other information and data pertaining thereto; all certificates of registration issued under this chapter; and all denials of applications. Applications for certificates shall be numbered in consecutive order as filed, and every certificate issued, and any renewal thereof, shall be identified with the duplicate number of the application upon which it was issued.
