If the grantee is awarded a final binding cable television franchise by any other municipality within one year after the effective date of this chapter (Ordinance 593, passed July 12, 1982), containing terms and conditions deemed by the grantor to be more beneficial to it, the grantor may elect to negotiate with the grantee to obtain such terms and conditions. However, such negotiations shall take into account all relevant facts and circumstances, including, but not limited to, rates and charges for services.
If the grantor grants additional franchises containing terms and conditions which the grantee deems to be more beneficial to it, the grantee may, at its option, elect to negotiate with the grantor to obtain such terms and conditions.
