(a) Public Nuisance Declared. The use or possession of weapons, explosives and other dangerous substances or devices in violation of this section is hereby declared a public nuisance in accordance with Section 634.01.
(b) Abatement. In accordance with Federal, State and local laws, any police officer shall seize, take, remove or cause to be removed at the expense of the owner any weapon, explosive or other dangerous substance or device used in any manner in violation of this section.
(c) Prohibited Acts.
(1) It shall be unlawful to discharge any firearm, air gun, BB gun, sling shot or any toy gun regardless of whether it projects lead or any missiles, except in a regularly licensed shooting gallery.
(2) No person shall bring onto public property, or have in his or her possession on public property within the Village, the following items:
A. Any explosive, dynamite cap or fireworks; any firearm or ammunition therefor, airgun, pellet gun, spring gun, slingshot, cross bow, bow and arrow or any other device by means of which a projectile can be propelled; any device which can be loaded with blank cartridges; any trapping device or any incendiary bomb or material, smoke or stink bomb, tear gas or other disabling chemical or agent.
B. Any look alike handgun which has the following characteristics or representations:
1. Its overall appearance, including shape, color, size, markings or lack of any markings, or any other identifying physical characteristic of the device, would lead a reasonable person to believe that the device is a handgun as defined in clause (h)(2) of subsection (A) of Section 24-3 of the Criminal Code; or
2. Is expressly or impliedly represented to be a handgun during the commission or attempted commission of an offense or is distributed under the circumstances that would lead a reasonable person to believe that the device is a handgun.
(d) Exceptions.
(1) Items set forth in subsection (c)(2)A. and (c)(2)B.1. hereof are not prohibited within a motor vehicle if unloaded or dismantled and in a closed carrying case, provided possession of such items does not violate any other Federal, State or local law, rule or regulation.
(2) The Parks and Recreation Commission may designate areas on a park where bows and arrows may be used. In such cases, the Commission shall promulgate regulations for the safe use of such devices.
(3) In accordance with Section 692.01(c) the President of the Board of Trustees may designate times and places where fireworks may be used in a park. The Parks and Recreation Commission shall promulgate regulations to ensure that, in such cases, the fireworks are used in a safe manner.
(4) The provisions of this section shall not apply to on duty authorized Village employees and officers nor to persons authorized under the statutes of this State or the United States to carry such weapons.
