692.02 USE OF LASER POINTERS.
   (a)   Laser Pointer Defined. For the purposes of this section, "laser pointer" shall mean a helium neon (HeNe) laser which operates at a wavelength of 632.8 nMe with the mandated power limit of 5mW of power; a diode laser which operates at a wavelength of 670 nMe with a power source providing 5mW; Class 2, 3a, 3b and 4 lasers; and any other laser pen, laser pointer or similar device which emits lasers or beams of light.
   (b)   Prohibited Acts. The following acts in regard to the possession, use and/or sale of laser pointers are hereby prohibited:
      (1)   Possession by minors. No person under the age of eighteen shall possess a laser pointer except in the residence of that person.
      (2)   Sale to minors. No person shall sell a laser pointer to any person under the age of eighteen.
      (3)   Use outside of buildings. No person shall use a laser pointer in such a manner that the laser beam illuminates on any person, animal, object or place located outside of the building where the person using the pointer is located.
      (4)   Use in places of public assembly. No unauthorized person shall use, display, point or shine a laser pointer in a concert hall, theater, movie theater or any other structure or place which is used or intended for use as locations for entertainment, lectures, concerts, sporting events, plays, dances and similar events, productions and performances. For the purposes of this paragraph, "unauthorized person" shall mean any person who does not have permission of the owner or operator of the place of public assembly to use a laser pointer in said place.
      (5)   Illumination of persons. No person shall use a laser pointer in such a manner that the laser beam illuminates on any person without such person's permission.
      (6)   Illumination of vehicle operators. No person shall use a laser pointer in such a manner as to illuminate the operator of a motor vehicle.
      (7)   Illumination of law enforcement personnel. No person shall use a laser pointer in such a manner that the laser beam illuminates a uniformed law enforcement officer or a law enforcement officer who identifies himself or herself as a law enforcement officer.
      (8)   Use in public places. No person shall use a laser pointer in or on a public right-of-way, street, alley, public park, or private parking lot accessible to the public.
   (c)   Exemptions. The provisions of this section shall not apply to the officers or members of the police force of the Village when on duty, nor to persons authorized under the statutes of this State or of the United States to carry weapons that have laser pointers/beams.
