In addition to any other provision of this chapter that requires the obtaining of a permit prior to engaging in a given activity in a park, no person shall conduct, operate, present, manage or take part in any activity for which a permit is deemed necessary under this chapter unless a permit issued by the Parks and Recreation Commission or the Parks and Recreation Director is obtained prior to the start of the activity in accordance with the following:
(a) Any group seeking exclusive use of the pavilion, bathrooms, open green space areas and fields shall obtain a permit prior to the date of intended use.
(b) General use permits are for resident and non-resident use including, but not limited to family reunion, birthday, graduation, and group gatherings. Special event use permits are for events with attendance over 100 people that would require approval prior to renting by the Village.
(c) Park permits shall be issued and permission granted only upon the payment of such fees as may be established from time to time by the Village. Groups (i) consisting primarily of Village residents; and (ii) where the person to whom the park permit is issued is a Village resident, will be entitled to one permit fee waiver per household per year. A refundable deposit may be charged to any person who wishes a park permit as well as other refundable charges for the use of recreational equipment or for the use of facilities requiring a park key.
(d) Procedures and application forms for park permits shall be determined by rules and regulations of the Commission.
(e) The person to whom a park permit is issued is liable for any loss of, or damage or injury to, any person or any property used in connection with the permitted activity. The Commission may require the permittee to provide a guarantee, security deposit, bond or insurance to ensure the payment for damage to property which may be caused by negligent use or for indemnification for such damage.
(f) The Commission or a law enforcement officer may revoke a park permit upon the violation of any rule or ordinance of the Village or upon the violation of any condition or restriction under which the permit was issued.
(g) No person shall refuse or fail to produce and exhibit any permit he or she claims to have, upon the request of any law enforcement officer or other authorized park employee who wishes to inspect the permit for the purpose of determining that the provisions of this chapter have been complied with.
