(a) No person shall sell, offer for sale, give away or deliver cigarettes or tobacco in any form to any person under the age of twenty-one (21) years. A sign shall be posted informing the public of the age restriction hereinabove provided at or near every place that cigarettes or tobacco in any form is offered for sale. Such sign shall be plainly visible and shall state in red letters at least one-inch high on a white background, as follows:
THE SALE OF TOBACCO PRODUCTS TO ANY PERSON UNDER TWENTY-ONE YEARS OF AGE IS PROHIBITED BY LAW
(b) No person under the age of twenty-one (21) years shall purchase cigarettes or tobacco in any form, or misrepresent his or her identity or age, or use false or altered identification, for the purpose of purchasing cigarettes or tobacco in any form.
(c) No person under the age of twenty-one (21) years shall possess cigarettes or tobacco in any form, unless such person is under the direct supervision of a parent or guardian or in the privacy of a parent's or guardian's home.
(d) No person under the age of sixteen years may sell any tobacco product at a retail establishment selling tobacco products. This subsection does not apply to a sales clerk in a family-owned business which can prove that the sales clerk is in fact a son or daughter of the owner.
