Except as provided by the Charitable Gaming Act or the Video Gaming Act, no person shall knowingly permit any gaming or gambling table, wheel or other gaming or gambling device to be set up or exhibited, or any policy or pool ticket to be kept or sold, for the purpose of gambling, in any building, room or premises, which belongs to him or her or is occupied by him or her or of which he or she has, at the time, possession.
