(a) Sales and Rental Reports. A person who leases dwellings in the Village or who, for consideration, attempts to negotiate the purchase, sale or listing of dwellings in the Village, shall maintain records and shall timely report to the Human Relations Commission, on a form made available by the Commission, the name, address and apparent race of persons who purchase, rent or inquire about dwellings in the Village and the location of such dwellings, in order to help the Commission identify unfair housing practices, analyze fair housing problems and administer and enforce this chapter and fair housing programs.
(b) Exceptions.
(1) A person who negotiates or attempts to negotiate the purchase, sale or listing of dwellings located in the Village, or a lessor who rents dwellings located in the Village, solely as an agent or contractor for a second person, is not required to provide information to the Commission pursuant to this chapter if the second person provides the Commission all such information that is required.
(2) A person who negotiates or attempts to negotiate the purchase, sale or listing of dwellings located in the Village, or any lessor who rents dwellings located in the Village, solely through agents or contractors, is not required to provide information to the Commission pursuant to this chapter if such agents or contractors provide the Commission all such information that is required.
(c) Use of Data. Data collected pursuant to this chapter shall be used only to assist the Village in administering fair housing programs and enforcing fair housing laws and shall be available for inspection only by the corporate authorities, the Commission, the Village Manager and his or her duly authorized assistants and other persons authorized by the Commission or the Manager to assist the Village in administering fair housing programs and enforcing fair housing laws. Any other use of such data shall constitute a violation of this chapter.
