252.09 SERVICE OUTSIDE VILLAGE LIMITS.
   The Fire Department shall provide services within the corporate boundaries of the Village. The following provisions, however, apply to any person who requires or receives ambulance, fire-oriented or nonfire emergency services of the Fire Department and whose property is located outside the Village:
   (a)   Generally. The members of the Fire Department may go outside the Village for the purpose of rendering aid to other fire departments, or of extinguishing fires or rendering emergency medical services, provided that the Department shall not render such service outside the Village except upon the order of the Fire Chief, the Assistant Chief or the Village Manager. The recipient of such service is subject to payment therefor, as set forth in subsection (b) hereof.
   (b)   Charges. The following charges apply to the provision of ambulance and fire-oriented emergency services to persons whose principal place of residence is not in the Village, as stated in this section:
      (1)   Ambulance or other nonfire emergency service. For any emergency ambulance or other nonfire emergency service rendered to any such nonresident, there is a service charge of one hundred dollars ($100.00) per call. The Fire Department shall respond to such calls so long as the residents of the Village will not be denied reasonable availability of the Department's personnel or services.
      (2)   Fire-oriented emergency service. For any fire-oriented emergency requiring the use of firefighting personnel or equipment which occurs on private property or on any street or road not in the Village, there is a service charge as follows:
         A.   Chief Response   $500.00 per hour
         B.   Engine         $400.00 per vehicle per hour
         C.   Truck         $600.00 per vehicle per hour
         D.   Rescue         $200.00 per vehicle per hour
         E.   Ambulance      $300.00 per vehicle per hour
   (c)   Level of Response. Services shall be rendered by the Department as required and as determined by the Fire Chief or the ranking officer on duty. The number of pieces of apparatus required shall be the sole determination of the Chief or the ranking officer, and such determination shall not be subject to review.
   (d)   Enforcement. Within five days after such nonresident services have been provided by the Department, the Chief or his or her appointed representative shall prepare a statement of costs of response, and the same shall be sent by certified mail to the owner of the subject property or to the individual receiving the services of the Department. If such statement of costs is not paid in full to the Village within ninety days, the Village Attorney is hereby empowered to take such legal steps as necessary to secure payment, including the filing of liens or judgments against the assets or ownership of the property or persons receiving the services.
   (e)   Mutual Aid Agreements. This section does not rescind, abrogate or modify any existing or future mutual aid agreement entered into by the Village. It is expressly understood that mutual aid agreements or commitments shall be honored only when requested under the terms and conditions of such agreements and shall not be deemed to be in effect unless requested by an authorized representative of a fire department or a fire protection association or district.
