(a) Appointment; Responsibilities. Police officers shall be appointed, except as provided in subsection (f) hereof, by the Fire and Police Commission. Each such officer shall discharge all of his or her duties faithfully and honorably in accordance with the law and with the directions and assignments given to him or her by the corporate authorities, the Village Manager and the Chief of Police. (b) Powers and Duties. Police officers shall have the power and authority, and it shall be their duty in and outside of the Village, when necessary and lawful, to serve and execute warrants and other processes for the apprehension and commitment of any person charged with a violation of any of the Village ordinances or any crime, misdemeanor or offense against the laws of the State, any person held for examination or trial or any person taken in execution for the commission of any crime or misdemeanor. Police officers shall also serve and execute any civil process issued on behalf of the Village by the County Circuit Court in any case, and while serving or executing in the service or execution of such warrant or process, they shall be vested with and have all the powers and authority conferred on constables at common law and by the laws of the State.

(c) Resignations. No member of the Police Department shall withdraw or resign except upon one week's notice in writing, given to the Chief of Police. The Chief may, however, waive such notice and permit the immediate withdrawal of such member. Any member who withdraws or resigns without such notice or permission, or who absents himself or herself from duty for five days without such leave, shall forfeit all pay due him or her.

(d) Badges. Every member of the Department designated to do so shall wear a suitable badge, to be furnished by the Village, and any member who loses or destroys his or her badge shall pay the cost of replacing it. Whenever any member leaves the Department he or she shall immediately deliver his or her badge, and all other articles in his or her possession belonging to the Village, to the Chief.

(e) Compensation of Disabled or Injured Officers. Any police officer who is injured or disabled while in the discharge of his or her duties so as to prevent him or her from attending to his or her duties shall, during such disability, receive his or her usual compensation. Such compensation, however, shall be paid for the first six months of such disability and no longer. Any payment received by a police officer under the "Illinois Workmen's Compensation Act," as amended, representing total temporary disability benefits shall reduce the amount payable under this subsection, whether such payment is made periodically or in a lump sum, provided that such payment represents compensation during periods of total temporary disability. The compensation provided for in this subsection shall be further adjusted to reflect any other payment under any other pension or disability plan.

(f) Alternate Procedure for Hiring Fully-Qualified Officers.
(1) For purposes of this section, "fully-qualified officer" shall mean an individual possessing all certifications and qualifications required by the Illinois Law Enforcement Training and Standards Board to be a full-time police officer, or an individual with equivalent qualifications from another agency who is able to obtain a waiver from the Illinois Law Enforcement Training and Standards Board to serve as a full-time police officer, and who is presently or previously been employed as a full-time certified police officer, and has at least two years of full-time experience.
(2) Whenever the Police Chief certifies to the President and Board of Trustees and Village Manager that there is a present need to hire one or more fully-qualified officers, the Village Manager is authorized to take applications to hire one or more such fully-qualified officers.
(3) Any such potential hires shall be subject to pre-employment background checks to be conducted by the Village's Police Commission in the same manner by which the Police Commission conducts background checks in the case of new hires.
(4) In such case. the Village Manager may place such newly-hired officers at a starting pay rate above the "start" pay rate up to and including the "after 5 years" pay rate provided in the Village's collective bargaining agreement with the FOP.
(5) Any such officer shall be considered newly-hired for all seniority purposes provided for in the Village's collective bargaining agreement with FOP, including, but not limited to probationary period, vacation selection, and shift selection.
