(a) There is hereby established, by and for the Village, a Police Department.
(b) The Police Department shall consist of a Chief of Police, who shall be appointed by the Village Manager, a Deputy Chief, Police Sergeants, Police Corporals, Police Patrol Officers and such other personnel as may be provided for, from time to time, by the President and the Board of Trustees.
(c) The Deputy Chief shall be appointed by the Chief of Police, subject to approval by the Village Manager. The position shall be considered an exempt rank and not subject to the rules, regulations or jurisdiction of the Fire and Police Commission. The appointment made pursuant to this subsection shall be based on merit, training, formal education and work experience and shall be limited to those personnel within the Department holding the rank of Sergeant.
(d) In the absence of the Chief of Police, the Deputy Chief shall be the Acting Chief of Police and shall assume all of the powers and duties of the Chief of Police. In the event of the absence of the Deputy Chief, the authority and command of the Department shall be delegated to a Sergeant following established rules and regulations of the Department. The powers, duties and responsibilities assigned to the Deputy Chief shall be prescribed by the Chief of Police by the issuance, from time to time, of general departmental orders, including, but not limited to, a job description order.
(e) The Deputy Chief may be removed from his or her position upon the recommendation of the Chief of Police. In the event that the Chief of Police shall recommend removal of said individual from said administrative position, he or she shall file with the Village Manager the reasons for such removal, and if the Manager is in accord with said removal, the removal shall become effective.
