§ 151.030 RESPONSIBILITIES OF OWNERS, OPERATORS AND OCCUPANTS.
   The following provisions shall pertain to the responsibilities of owners, operators and occupants of dwellings and dwelling units and their premises.
   (A)   In the absence of a written agreement between the occupant and the owner or operator to the contrary, every occupant of a dwelling or dwelling unit shall keep in a clean and sanitary condition that portion of the dwelling, dwelling unit and premises thereof which he or she occupies and controls.
   (B)   Every owner or operator of a dwelling containing two or more dwelling units shall be responsible for maintaining in a clean and sanitary condition the common areas of the dwelling and premises.
   (C)   Every occupant of a dwelling or dwelling unit shall dispose of all his or her rubbish in a sanitary manner by placing it in the rubbish containers required by Chapter 52 of this code of ordinances.
   (D)   Every occupant of a dwelling or dwelling unit shall dispose of all his or her garbage and other organic waste which may provide food for rodents in a clean, safe and sanitary manner by placing it in the garbage disposal facilities or garbage storage containers required by Chapter 52 of this code of ordinances. The containers shall be kept tightly closed.
   (E)   Every occupant of a dwelling unit shall be responsible for hanging all screens and double or storm doors and windows whenever they are required under the provisions of this chapter or of any regulation adopted pursuant thereto, except where the owner has agreed to supply the service.
   (F)   Every occupant of a dwelling containing a single dwelling unit shall be responsible for the extermination of any insects, rodents or other pests in or on the premises, and every occupant of a dwelling unit in a dwelling containing more than one dwelling unit shall be responsible for the extermination whenever his or her dwelling unit is the only one infested.
   (G)   (1)   Notwithstanding the foregoing provisions of this section, whenever infestation is caused by failure of the owner to maintain a dwelling in a rat-proof or reasonable insect-proof condition, extermination shall be the responsibility of the owner.
      (2)   Whenever infestation exists in two or more dwelling units in any dwelling, or in the shared or public parts of any dwelling containing two or more dwelling units, extermination shall be the responsibility of the owner.
   (H)   Every occupant of a dwelling unit shall keep all plumbing fixtures in a sanitary condition and shall be responsible for the exercise of reasonable care in his or her proper use and operation.
   (I)   Whenever a dwelling unit is vacated, it shall be the duty of the owner to place it in a sanitary, habitable condition and free from infestation before renting the dwelling unit to another occupant.
   (J)   No owner shall occupy or let to any other person any dwelling unit unless it is sanitary and fit for human habitation.
   (K)   No owner, operator or occupant shall cause any service facility, equipment or utility which is required under this chapter to be removed or shut off from, or discontinued for any occupied dwelling, except for such temporary interruptions as may be necessary while actual repairs or alterations are in process.
   (L)   Every occupant of a dwelling unit shall be responsible for the exercise of proper care and cleanliness in the use and operation of all plumbing fixtures, sanitary facilities, appliances and equipment.
   (M)   (1)   Every owner or operator of a dwelling who permits to be occupied any dwelling unit therein under an agreement, express or implied, to supply or furnish heat to the occupants shall maintain the heat at the temperature specified in § 151.016(A).
      (2)   The provisions of this section shall not apply when the failure to maintain the required air temperature level is because of a shortage of fuel, a negligent or malicious act of the occupant, repairs being expeditiously made to the heating equipment or any cause beyond the control of the owner or operator.
   (N)   An owner shall be responsible for violation of duties imposed on him or her by this chapter even though:
      (1)   An obligation is also imposed on the occupants by this chapter; or
      (2)   The owner has by agreement imposed on the occupant the duty of complying with this chapter.
