(A) If a tagged vehicle or parts are not removed within 72 hours of tagging and the police officer (“officer”) suspects the market value of the vehicle is $750 or less, the officer shall prepare a written abandoned vehicle report of the vehicle or parts, including information on the condition, missing parts and other facts that might substantiate the estimated market value of the vehicle or parts. Photographs shall be taken to describe the condition of the vehicle or parts.
(B) (1) This assessment, described in division (A) above, shall be performed by an officer designated by the city’s Chief of Police. If the assessment confirms the market value of the vehicle is $750 or less, the officer shall provide for the immediate disposal of the vehicle to the contracted towing service. A copy of the abandoned vehicle report and photographs relating to the abandoned vehicle shall be forwarded to the Bureau of Motor Vehicles.
(2) The towing service may dispose of the abandoned vehicle not less than 30 days after the date on which the towing service removed the abandoned vehicle and after the assessment has been made by the city’s Police Department.
(C) The city’s Police Department shall retain a copy of the assessment and any photographs for two years after the disposal of the vehicle or parts.
(D) If the assessment indicates the market value of the vehicle is greater than $750, the notification and disposal procedures in I.C. 9-22-1-23 et seq. shall be followed.
