§ 58.082 REMEDIES FOR PROHIBITED DISCHARGES; AUTHORITY OF DIRECTOR.
   (A)   If any waters or wastes that contain the substances or possess the characteristics enumerated in § 58.081 are proposed to be discharged to the public sewers, the Director may do the following:
      (1)   Reject the wastes in whole or in part;
      (2)   Require pretreatment of the wastes as necessary to comply with the limitations defined in this chapter;
      (3)   Require payment of a surcharge on any excessive flows or loadings discharged to the treatment works to cover the additional costs of having capacity for the treating of the wastes; and
      (4)   The Director may develop best management practices (BMP) by ordinance or in industrial wastewater discharge permits or general permits, to implement local limits and the requirements of § 58.081.
   (B)   If the Director permits pretreatment, equalization of wastes equalization of waste flows, or establishes best management practices (BMP), the industrial user must develop and submit a compliance schedule for the design and installation of the technology required to meet applicable pretreatment standards. The compliance schedule, design and equipment shall be subject to the approval of the Director and subject to the requirements of all applicable codes, ordinances and laws.
