953.08 RULES AND REGULATIONS.
   The following rules and regulations shall govern the use of the Lodge and/or the adjacent picnic and parking facilities.
   (a)   Any devices, such as electrical, plumbing or otherwise, brought on or added by the organization or persons using the Lodge, may be added or connected only with the permission of the Director of Public Service and Properties or the Mayor.
   (b)   All interior furnishings or equipment shall be kept inside and used only for the purpose intended. All exterior furnishings or equipment shall be used only for the purpose intended.
   (c)   No decorations, furniture or special equipment by the group or organization using the building shall be permitted in or about the premises unless approved by the Director of Public Service and Properties or the Mayor.
   (d)   The kitchen, if used, and all papers, garbage or rubbish shall be neatly cleaned up and put in the containers provided outside. All furniture or special equipment furnished by the group or organization using the building shall be removed on the same date that the building is used by such group or organization.
   (e)   Vehicular parking for members of groups using the Lodge shall be limited to the parking areas designated.
   (f)   All youth activities shall be adequately chaperoned with adult supervision.
   (g)   Any permit issued shall be governed by the current set of rules established by the City and posted at the Lodge. A copy shall be provided with each permit issued.

   (h)   Rowdyism, disorderly conduct, discourteous behavior of attendees toward others, including City employees, and malicious destruction of property in or about the building are hereby prohibited. At the sole discretion of the Administrative Authority, such actions may result in the denial of future use and rental of the Lodge facilities by the permit holders and/or attendees involved in such actions.

   (i)   The maximum capacity of the Lodge when used pursuant to the provisions of this chapter shall be as provided in the following table:

   (j)   Charitable organizations may lawfully conduct gambling activities provided it meets each and every following condition:
      (1)   It has in its possession (and produces a copy of the same) a letter from the U.S. Internal Revenue Service stating that the charitable organization is exempt from Federal income taxes under Section 501(a) of the Internal Revenue Code at the time of the gambling event.
      (2)   Only the price of the prizes won by participants are deducted from the gambling proceeds.
      (3)   All other gambling proceeds are used by or transferred to a tax exempt organization having Section 501(a) certificate or as described in Section 501 of the Internal Revenue Code.
      (4)   The event is not conducted within ten hours of a bingo game conducted on the premises for amusement purposes only pursuant to Ohio R.C. 2915.02(D)(1) or Richmond Heights Codified Ordinances Section 517.02 (c).
      (5)   The activity or game of chance does not include craps for money, roulette for money or the use of slot machines, all of which are illegal.
   (k)   A charitable organization, as defined in Section 501(a) of the Internal Revenue Code, may conduct poker games, use punch boards or conduct other games of chance (except craps for money, roulette for money or the use of slot machines) provided it meets all of the following conditions:
      (1)   The organization has in its possession a letter from the Internal Revenue Service saying that it is exempt from Federal income taxes (under Section 501(a) IRC) at the time of the event.
      (2)   The games/events are held at a festival of the organization that lasts four consecutive days or less and occurs not more than twice a year.
      (3)   Only the price of the prizes won by participants is deducted from the gambling proceeds.
      (4)   All of the rest of the money is used by or transferred to a tax exempt organization (under Section 501(a) IRC or described in Section 501 IRC).
      (5)   The event is not conducted within ten hours of a bingo game conducted for amusement purposes.
      (6)   The charitable organization does not pay the operators, conductors or assistants operating or conducting the gambling any compensation or gratuity.

   (l)   The sale of alcoholic beverages shall be permitted at the Lodge only by groups or organizations who have obtained and submitted a permit for the sale under existing Ohio Liquor Laws. Any event, meeting or engagement at the Lodge facilities at which alcoholic beverages are being consumed shall cease service of any alcoholic beverages no later than 11:30 p.m. and the event, meeting or engagement must end no later than 12:00 midnight.

   (m)   Any person desiring to rent any of the Lodge facilities must be twenty-one years of age or older.
   (n)   Any right or privilege granted to any person, persons or organization to use the Kiwanis Lodge or any part thereof is personal and exclusive and shall not be transferred to any other person or organization.

   (o)   Any individual household of the City or business entity located in the City shall be eligible to use the Lodge and apply for a permit for such use for only two engagement dates during any calendar year. This provision shall not apply to the sanctioned organizations listed in Section 953.02 .
