(A) Whenever the Fire Chief determines as a result of his inspection under § 92.26 that a property is especially susceptible to fire loss or that combustible, explosive or flammable materials are found on a property likely to result in a fire loss, and after the report of § 92.26 has been completed, he shall order the property owner to remedy the susceptibility to fire loss or remedy the likelihood of a fire loss. The order shall be issued by certified mail to the landowner using the form entitled Exhibit “A” on file in the offices of the city and should the certified mail procedure fail the order shall be served by the Madison County Sheriff. The order shall forthwith be complied with by the property owner.
(1) The Fire Chief of the city may designate by letter the Fire Marshall of the city as the officer responsible for performing the duties under this section.
(2) The Fire Chief of the city or the Fire Marshall of the city if so designated by the Fire Chief shall only issue the order permitted by this section if he or she finds on the property one or more of the following:
(a) A want of repairs constituting a condition likely to cause fire loss.
(b) A lack of sufficient fire escapes likely to cause fire loss.
(c) The age of the property likely to cause fire loss.
(d) The dilapidated condition of the property likely to cause fire loss.
(e) Combustible or explosive or flammable matter or material likely to result in fire loss.
(f) Any other likely cause for a fire loss.
(B) The owner of the property on which an order has been issued by the Fire Chief or his designated representative may appeal the order to the Commissioner of Housing, Buildings, and Construction of the Cabinet for Public Protection and Regulation, Commonwealth of Kentucky, Frankfort, Kentucky within 10 days of receipt of the order. The Commissioner will review the order within 20 days and file a decision. The order remains in full force and effect until revoked or modified by the Commissioner.
