§ 54.01 RATES.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      INSTITUTIONAL USERS. Eastern Kentucky University, the public school system, Baptist Health Hospital and organizations of a similar nature and purpose.
      SANITATION DISTRICT. Wastewater flows from existing specified Madison County residential areas that existed on January 1, 1998, and were identified in the city/county agreement signed on May 26, 1999. Areas are limited to:
      (1)   Madison Village/Lexington Road, Whitehall Manor;
      (2)   Green's Circle/Robinsonville-Estonia Estates;
      (3)   Reba Drive;
      (4)   Terrill Acres-Clarksville Subdivision;
      (5)   Executive Park;
      (6)   Deacon Hills-Idylwild-Brocklyn Subdivision; and
      (7)   Third Street-Country Club Heights.
      WHOLESALE PURCHASERS. Madison County Utility District and Kirksville Water Association, and water districts of a similar nature purpose.
   (B)   Phase I. The schedule of rates to be charged to customers on bills mailed after July 1, 2005 shall be as follows:
      (1)   Institutional rates. The schedule of rates to be charged to institutional water users within the city limits of the city shall be as follows:

      (2)   Milford Water District. The schedule of rates to be charged all customers of the former Milford Water District are as follows:

   (E)   Phase IV. Beginning on July 1, 2008, all rates shall be adjusted annually on bills mailed after July 1 of each year to reflect Richmond Water, Gas and Sewerage Works increase in costs for operation water treatment. The annual adjustment shall be equal to average percentage change in the Consumer Price Index for all urban consumers (U.S. city average) published by the U.S. Department of Labor, Bureau of Labor Statistics, however the annual adjustment shall never be less than zero.
   (F)   The schedule of rates to be charged to customers on bills mailed after July 1, 2022 shall be as follows:
      (1)   Institutional rates. The schedule of rates to be charged to institutional water users within the city limits shall be as follows:

      (2)   Milford Water District. The schedule of rates to be charged all customers of the former Milford Water District are as follows:

      (4)   Schedule of rates for all customers excluding Wholesale Purchasers shall be adjusted annually on bills mailed after July 1 of each year to reflect Richmond Water, Gas & Sewerage Works increase in costs for operation.    (G)   (1)   A water meter surcharge in the amount of $2.10 shall be shall be charged to customers for every water meter serviced by the Utilities Board. The surcharge shall be deemed to be a sale and shall not be subject to the school, sales business, or other taxes applicable to the sale of water.
      (2)   The Utilities Board shall receive and account for all water meter surcharges collected hereunder, as provided by law for public funds, and shall, on a monthly basis, transfer all funds so collected to the Storm Water Project Fund for purposes of providing the city a return on its investment in the utility system.
      (3)   The surcharge established herein shall be applied to all bills on or after one month from passage.
