1507.05 PERMIT TO BURN CONSTRUCTION DEBRIS.
   (a)   Notwithstanding any other provision of Ohio R.C. Chapter 3704 or any rule adopted pursuant thereto, the Municipality may issue permits to contractors engaged in the construction of buildings for the open burning of construction debris only on the construction site, lot or recorded plat referred to in the permit application, if such building is supervised by an employee at all times. Construction debris which may be burned under this section shall be limited to natural wood, lumber, paper, cardboard and wooden boxes but not including any product having a rubber or petroleum base. The Municipality may make rules applicable to issuance and use of permits as are reasonably necessary to guarantee the public health and safety and necessary to ensure the efficient operation of the permit system, and such rules may contain a schedule of fees for the permits. The Municipality may revoke a permit for violation of any provision of this section or any rule adopted by the Municipality pursuant thereto. Annually, in accordance with a schedule specified by the Ohio Director of Environmental Protection, the Municipality shall report to the Director the number of permits issued, renewed and revoked for the preceding calendar year.
   (b)   No contractor shall burn construction debris under a permit issued pursuant to subsection (a) hereof during an air pollution alert, warning or emergency for the area of the construction site.

1507.06 PERMIT: ISSUANCE, USE AND FEE.
   No person shall kindle, maintain or authorize burning of construction debris as provided in Section 1507.05 without a permit.
   (a)   Permit Issuance.
      (1)   The permit shall be issued for a period not to exceed six months, by the Building Division.
      (2)   Burning approval and monitoring will be by the Fire District.
      (3)   The Fire Chief may disallow such burning when conditions or circumstances make the fires hazardous.
      (4)   Burning under such permit ceases when the building is first inhabited.
   (b)   Permit Fee.
      (1)   Each building construction site, ten dollars ($10.00).
      (2)   Land clearing:
         A.   1 to 5 acres - $100.00;
         B.   Over 5 acres - $150.00.
   (c)   Permit Use: Location Restricted. No person shall kindle such fire unless:
      (1)   Fire site is fifty feet from any structure;
      (2)   Provisions are made to prevent spread of fire;
      (3)   Fire is contained in an approved container twenty-five feet from any structure;
      (4)   Fire is constantly attended by a person with fire extinguishing equipment as specified by the Fire Chief or his representative until such fire is extinguished.
      (5)   Hours of burning shall be 8:00 a.m. to 4:00 p.m.

1507.99 PENALTY.
   Whoever violates any provision of this chapter is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both.
