537.14 CURFEW.
   (a)   Sunday through Thursday no minor under the age of fifteen years shall be beyond the property line of his or her residential property between the hours of 10:00 p.m. and 4:30 a.m. the following day unless accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or when the minor is on an emergency errand or legitimate business directed by a parent of the minor, guardian of the minor, or other adult person having the care and custody of the minor.
   (b)   Friday and Saturday no minor under the age of fifteen shall be beyond the property line of his or her residential property between the hours of 11:00 p.m. and 4:30 a.m. the following day unless accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or when the minor is on an emergency errand or legitimate business directed by a parent of the minor, guardian of the minor, or other adult person having the care and custody of the minor.
   (c)   Sunday through Thursday no minor between the ages of fifteen through seventeen shall be beyond the property line of his or her residential property between the hours of 11:00 p.m. and 4:30 a.m. the following day unless accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or when the minor is on an emergency errand or legitimate business directed by a parent of the minor, guardian of the minor, or other adult person having the care and custody of the minor.
   (d)   Saturday and Sunday no minor between the ages of fifteen through seventeen shall be beyond the property line of his or her residential property between the hours of 12:00 a.m. and 4:30 a.m. unless accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or when the minor is on an emergency errand or legitimate business directed by a parent of the minor, guardian of the minor, or other adult person having the care and custody of the minor.
   (e)   The first violation of sections (a) through (d) shall come under the jurisdiction of the Mayors Court Diversion Program established by the county juvenile court.
   (f)   The second and subsequent violations of sections (a) through (d) shall be filed in the county juvenile court in which any of the following orders of disposition may be made for the offense of curfew violation pursuant to Ohio R.C. Section 2151.355 - Orders of Disposition for a Delinquent Child:
      (1)   Place a child on probation under any conditions that the court prescribes;
      (2)   Commit the child to the temporary custody of any school, camp, institution, or any other facility operated for the care of delinquent children;
      (3)   Suspend or revoke the driver's license or temporary instruction permit issued to the child or suspend or revoke the registration of all motor vehicles registered in the name of the child;
      (4)   Commit the child to the temporary or permanent custody of the court;
      (5)   Make any further disposition that the court finds proper.
   (g)   No person, being the parent of the minor, guardian of the minor, or other adult person having the care and custody of the minor shall permit or neglectfully allow the minor to violate divisions (a) through (d).
   (h)   If a minor has been determined to be a delinquent child by a county juvenile court then a violation of division (g) is a minor misdemeanor.
   (i)   No minor between and including the ages of six and 17 years, shall be upon or about the public streets, public places, commercial establishments or places of amusement or entertainment within the city during the school days throughout the academic school year while under suspension or expulsion, except where one of the following applies:
      (1)   The child is accompanied by a parent, guardian or person having legal custody and control of that child.
      (2)   The child is employed pursuant to ages and schooling certificate, during the actual working hours or traveling directly to or from the job site.
      (3)   The child is on a verifiable emergency errand.
   (j)   A child who violates division (i) of this section is guilty of being an unruly child in accordance with Ohio R.C. 2151.022.
   (k)   A child who violates division (i) of this section shall be taken into custody under the authority of Ohio R.C. 2151.21(A)(6)(a) and the child shall then be processed and released within statutory guidelines set forth in Ohio R.C. 2151.311 and 2151.312.
