The purpose of this chapter is to establish regulations governing certain temporary or intermittent uses or activities proposed within developed commercial or industrial zoned properties and to allow temporary retail sales or other special events which are not related to any holiday event regulated by chapter 18.194 of this title.
A. A "temporary sales and special event facility" (hereinafter "facility or facilities") means an outdoor facility proposed to be located within developed commercial or industrial zoned properties that is devoted to the sale of goods or services for any organization, which represents a variation from the facility's normal operation or location. Examples include, but are not limited to:
1. Parking lot sales events;
2. Automobile sales for dealerships proposing to use off site premises for an event, and whose principal dealership location is in the city;
3. Charitable fundraisers for nonprofit organizations;
4. Carnivals, circuses and other entertainment events, excluding concerts.
B. All facilities shall be subject to the following requirements:
1. Period Of Operation: The facility may be conducted any time during the year. The permit issued will allow the operation of the facility for a maximum of three (3) consecutive days of use. A maximum of four (4) permits may be issued to any property in any calendar year.
2. Site Restrictions: Facilities are prohibited on vacant and unimproved lots.
3. Electrical Permit: An applicant shall secure an electrical permit should the facility need to be energized.
4. Removal Of Facility: Within two (2) days of its closing, the facility shall be removed and the site cleared of all debris and restored to at least as good a condition as existed prior to the establishment of the facility.
5. Fire Prevention Standards: Each facility shall comply with fire prevention standards as approved and enforced by the fire chief.
6. Business License: All businesses that apply for a facility permit must have a city of Redlands business license.
7. Other Permits: An applicant shall apply for and obtain all other permits needed to conduct the facility.
C. Facility permit applicants may be required, at the discretion of the development services director ("director"), to post a cash deposit or other security satisfactory to the city in an amount sufficient to restore the site of the facility to its preexisting condition. The applicant shall also provide the city with written permission for the city to enter the site for cleanup at the applicant's cost. (Ord. 2763, 2012)
