§ 141-220. Animal Control Board; powers and duties.

   A.   The Animal Control Board is authorized to prepare written rules and regulations to govern its operations and conduct hearings before it. The rules and regulations shall become effective upon the approval, by resolution, of City Council. Copies of the Board’s rules and regulations shall be available for inspection by the public in the Office of the City Clerk. [Amended 6-23-2014 by Ord. No. 48-2014]
   B.   The Board shall also have the authority to do the following:
      (1)   Receive requests for permission to own exotic animals, domestic agricultural animals, native wildlife animals and requests to own more than six dogs/cats; conduct an investigation it deems proper and hold hearings in conjunction with such investigation. The Board may grant, in writing, permits for the keeping of exotic animals, domestic agricultural animals, native wildlife animals, aggressive dogs, vicious animals and more than six dogs/cats and may impose any condition on such permission that it deems necessary to protect the animal, owner, and the general public.
      (2)   Hear appeals of owners of animals determined to be vicious animals or aggressive dogs as defined under § 141-202, Definitions. [Amended 6-23-2014 by Ord. No. 48-2014]
      (3)   Impose any or all of the sanctions and remedies set forth at § 141- 221 for violations of this Part.
    C.   The Board shall meet at the call of the Chairperson to recommend changes in the law regarding the control of animals to City Council. [Amended 6-23-2014 by Ord. No. 48-2014]
   D.   Removal of members. Any member may be removed for misconduct or neglect of duty or for other just cause by a majority vote of Council taken after the member has received 15 days’ advance notice of the intent to take such vote. Failure of a member to attend three consecutive regular meetings of the Board will constitute grounds for immediate removal from the Board by City Council. Failure of a member to attend at least 50% of the regular meetings of the Board in a calendar year will constitute grounds for immediate removal from the Board by City Council. The Chairperson of the Board shall inform the City Clerk in writing when a member has failed to comply with this attendance policy. Following such notification, City Council may vote to remove the member and seek applicants to fill the vacant position. [Amended 9-27-2010 by Ord. No. 73-2010]
