A. Any party aggrieved by the aforesaid procedures to abate, bill and collect costs for the abatement of a violation of this Part shall have the right to appeal to the Code and License Appeals Board, Chapter 23, Part 14, by filing an appeal request with the Property Maintenance Division Manager 15 days after the issuance of the bill for collection of costs for abatement of the violation. An administrative fee defined in Chapter 212 Fees shall be charged for each appeal. The appeal fee shall be refunded if the appeal is approved by the Code and License Appeals Board.
B. Appeals to the Code and License Appeals Board shall stay the enforcement of this part.
C. The decision of Code and License Appeals Board may be appealed to the Court of Common Pleas of Berks County within 30 days after notice of the decision has been made.
D. Nothing in this section shall be construed as to limit the right to appeal a Summary Conviction for a violation of this Part to the Court of Common Pleas.
