§ 496-211. Collection vehicles.
A.   All owners/operators of vehicles used in the collection or transportation of municipal waste or residual waste within the City limits shall comply with all requirements of the PA Waste Transportation & Safety Act, 25 PA Code §285, and all other relevant laws, rules, and regulations of the Commonwealth.
B.   All collection vehicles transporting solid waste within the City shall:
   (1)   Be designed specifically for the collection and transportation of solid waste;
   (2)   Be of waterproof construction;
   (3)   Be constructed and maintained in good working condition that limits hazards and nuisances such as, but not limited to: spills, scattering of material outside the vehicle, generation and leakage of leachate, odors;
   (4)   Be of safe construction, without attachments, appendages, or other conditions which could create a significant safety hazard for operators, other drivers, the general public, or public or private property;
   (5)   Be equipped with a fire extinguisher with a current inspection;
   (6)   Load compartments shall be provided with drain plugs or valves at the lowest point.
C.   Vehicles not specifically designed for the collection and storage of solid waste, such as pick-up trucks, box trucks, or other general service vehicles, shall only be used by licensed haulers provided that:
   (1)   The vehicle is properly secured such that nothing shall be strewn from the vehicle, either while in motion or while stationary;
   (2)   The vehicle is covered securely by a waterproof material;
   (3)   The vehicle is used only for the collection of:
      (a)   Construction/demolition waste;
      (b)   Recyclable materials;
      (c)   Waste that was not collected during regular collection by the primary collection vehicle due to a missed stop or late waste placement;
      (d)   Large or bulky items, or similar services.
   (4)   The use of the vehicle and collection activity comply with all other relevant laws, rules, and regulations of the Commonwealth.
D.   Parking. Vehicles used for collecting solid waste shall, at all times, be subject to the following parking restrictions:
   (1)   If loaded or partially loaded:
      (a)   No parking or standing on any street, highway or alley at any time in excess of one hour;
      (b)   No off-street parking at any time in excess of two hours.
   (2)   If empty:
      (a)   No parking on any highways, streets or alleys at any time in excess of one hour;
      (b)   No off-street parking at any time in excess of 48 hours and no more than four hours if the vehicle is within 400 feet of an occupied dwelling or in a residential area.
   (3)   Permitted parking. Compliance with Chapter 600, Zoning, shall be required.
E.   All vehicles shall always be kept clean and well maintained so as not to create a public nuisance or present in any way a threat to the public health and safety and shall at all times be subject to rigid inspection by any police officer or any authorized agent of the City. Additionally, all vehicles shall be kept free of graffiti.
