§ 496-210. Licensed haulers.
   A.   Only private licensed haulers, licensed by the Commonwealth of Pennsylvania, may collect or remove solid waste from any property within the City of Reading.
   B.   Licensed haulers must dispose of solid waste in permitted facilities according to all applicable regulations.
   C.   Licensed haulers shall make a good faith effort to refrain from picking up or removing any bag or container of municipal waste known or believed to contain designated recyclable materials. Upon discovery of such materials combined with municipal waste, the licensed hauler shall reject the material and affix a tag or sticker indicating the type of contamination.
   D.   All licensed haulers shall provide, at minimum, one annual bulky waste item collection per year or provide information to their customers about bulky waste disposal options.
   E.   Collection and transportation service.
      (1)   Any hauler collecting or transporting solid waste or designated recyclable materials shall:
         (a)   Prevent and remedy any spillage from their vehicle or containers;
         (b)   Not transfer material from one collection vehicle to another within the City;
         (c)   Return the collection container to the premises from which it was removed;
         (d)   Remedy, within four hours of notification by the City, any material which, by accident or otherwise, may have been placed or fallen in the public right-of-way by such hauler.
      (2)   All complaints to licensed haulers regarding the collection or transport of material, with the exception of complaints concerning the municipal collection program, shall be made directly to the licensed hauler responsible for such service.
   F.   In the event of contract termination, it shall be the responsibility of the licensed hauler servicing a property to empty and remove any collection containers provided by said hauler.
   G.   Any licensed hauler who desires to place any large storage or collection container within the public right-of-way shall comply with all City ordinances including obtaining any necessary permits.
   H.   Reporting responsibility.
      (1)   Licensed haulers.
         (a)   All licensed haulers operating within the City of Reading shall annually report, at minimum, the following information for each property serviced to the Department of Public Works of the City of Reading no later than February 1st:
            (i)   List of all properties serviced;
            (ii)   Day(s) of week each property is serviced;
            (iii)   Property owners/operators name, mailing address, and telephone number;
            (iv)   Type of service provided (municipal waste or recycling);
            (v)   Type of property (multi-dwelling or commercial); [Amended 1-25-2021 by Ord. No. 8-2021]
            (vi)   Annual recycling report, which shall be provided by the City.
         (b)   All licensed haulers operating within the City of Reading shall notify the City, no later than the 15th of the month, of any properties added or removed from their service.
         (c)   Failure by a licensed hauler to provide annual reporting or monthly list of properties added or removed from their service may result in suspension of hauler's business license and placement of customers on City trash service, where applicable.
