A. If the City determines that a proposed public works improvement must be performed for the health, safety and welfare of the public, the City shall have the power to levy special assessments to benefitted properties for the improvements and services provided. The City shall include the proposed project in the upcoming year's annual budget and capital improvement plan. The City may not proceed with the project engineering until after the budget and capital improvement plan is approved by the Council.
B. The City may levy a special assessment for public works improvement if a simple majority of benefitted property owner's petition the City to perform a public improvement. This shall apply to streets, sidewalks, curbs, private alleys, streetlights, water mains and sewers.
C. For an alley improvement project to be included in the next budget year, the request must be submitted to the City Clerk by July 1 prior to the budget year. The alley projects shall be prioritized with other City projects and will be the City's sole discretion to determine scheduling for such an improvement.
