§ 496-208. Private collection.
   A.   It shall be the responsibility of all property owners/operators not enrolled in the City's municipal collection program to provide for, at their own expense, collection services for all solid waste and designated recyclable materials.
      (1)   It shall be prohibited for property owners/operators to self-haul solid waste unless the owner/operator is a licensed hauler.
      (2)   Property owners/operators shall contract with a licensed hauler for collection services.
      (3)   Contracted collection services shall abide by regulations set forth in §496-210 of this Part.
      (4)   Storage, collection, and disposal services must meet the requirements of this chapter and all other City codes.
      (5)   The property owner/operator shall provide the City with evidence of a private contract/agreement with a licensed hauler within 5 days of entering into a new agreement, or the City may consider the property to have no current waste hauler.
      (6)   The City reserves the right to periodically request proof of collection services in the form of a collection contract, invoices, and weight slips. The City may use the annual customer list provided by a licensed hauler as sufficient proof of collection service.
   B.   All owners/operators of properties not enrolled in the City's municipal collection program must establish a recycling program, including suitable containers in easily accessible locations and instructions to occupants, that provides for the storage and collection of at least the following recyclable materials:
      (1)   Multi-dwelling units: all designated recyclable materials; [Amended 1-25-2021 by Ord. No. 8-2021]
      (2)   Nonresidential units: cardboard, aluminum, metal cans, and high grade office paper. These entities should also recycle any materials commonly recycled in their industry or trade.
   C.   If an owner/operator of a property not identified as a residential unit requests but is not approved to add the property to the municipal collection program, the property owner/operator must maintain an active collection agreement with a licensed hauler according to the rules in this Part.
   D.   It shall be the responsibility of all sponsors and organizers of community activities to provide for, at their own expense, solid waste and designated recyclable material collection services as are appropriate for the event. Public waste containers and dumpsters are not to be used for waste disposal from community activities without prior approval by the Public Works Director, or his/her designee.
   E.   Exemptions.
      (1)   Certain properties may be exempt from the requirement to have an active solid waste and recycling collection service, provided they meet any of the following conditions:
         (a)   Vacant lot - property is a vacant lot with no tangible structure;
         (b)   Side lot - a property that functions as a yard or secondary lot to an adjacent residence or business, provided that the residence or business is on the municipal collection program or has an active collection agreement;
         (c)   Surface parking lot - Ground-level parking lots not affiliated with an adjacent business;
         (d)   Vacant buildings - If a building is deemed vacant, solid waste and recycling collection services may be suspended only if water service is suspended. If water service resumes, solid waste and recycling collection services must also resume.
      (2)   The Public Works Director, or his/her designee, will make final determination whether a property is eligible for exclusion from collection services.
   F.   Private collection requirements.
      (1)   All containers used for private collection services that are placed in the public right-of-way shall be placed there no earlier than 5:00 p.m. the day before the scheduled collection. Containers placed in the public right-of-way shall be returned to a storage location no later than daybreak on the day after the scheduled collection.
      (2)   Owners/operators choosing to self-haul their recyclable materials shall save all weight slips provided by the processing facility and complete and return to the City an annual form, made publicly available by the City, indicating annual recycling tonnage. All self-hauled recyclable materials must be taken to a recycling facility permitted by the Pennsylvania Department of Environmental Protection.
