§ 496-201. Definitions.

In addition to the definitions in Part 1 Section 496-101 as amended which are hereby incorporated by reference as being more fully stated herein, the following words and phrases, when used in this Part, shall have, unless the context clearly indicates otherwise, the meanings given to them in this section.
BULKY WASTE — Any municipal waste that will not fit into a standard trash container, such as small furniture, carpet, mattresses, and box springs. Appliances containing freon must have the freon removed by a certified technician prior to placement for collection. For safety purposes, doors must be removed prior to placement for collection.
CART/TOTER — Any container which is made of rigid plastic, with two wheels, which is intended to be mechanically emptied and used for the purpose of temporarily holding refuse with a maximum capacity of one-half cubic yard or 96 gallons.
COMMUNITY ACTIVITIES — Events sponsored in whole or in part by a municipality, or conducted within a municipality and sponsored privately, that are required to obtain an event permit from the City, which include, but are not limited to fairs, bazaars, socials, picnics and organized sporting events.
CURBSIDE — The correct location for the placement of material to be collected as part of the municipal collection program, which shall be:
   A.   On the enrolled property adjacent to the curb;
   B.   Be no more than five feet from the public street, or
   C.   If an accommodation is approved by the City due to the physical unfeasibility of curbside collection at the property or a property owner or resident's disability, placement may be made at a specified location such as a rear alley or other approved location.
CITY — The City of Reading, Berks County, Pennsylvania.
CONSTRUCTION/DEMOLITION WASTE — Solid waste resulting from the construction or demolition of buildings and other structures including, but not limited to, wood, plaster, metals, asphalt substances, bricks, block and unsegregated concrete.
CONTAINER — A hollow object used to hold municipal waste or recycling.
DESIGNATED RECYCLABLE MATERIALS — Source-separated recyclable materials, specified by §496-205 of this Part, that are designated to be separated for collection in the City of Reading. Such materials may include, but are not limited to, clear glass, colored glass, aluminum, steel and bimetallic cans, high-grade office paper, newsprint, corrugated paper, plastics, leaf waste, electronic waste, and tires.
DISPOSAL — The incineration, deposition, injection, dumping, spilling, leaking, or placing of solid waste into or on the land or water in a manner that the solid waste or a constituent of the solid waste enters the environment, is emitted into the air or is discharged to the waters of the Commonwealth.
DWELLING UNIT — see Ch. 180 “Property Maintenance Code” section 202.
ELECTRONIC WASTE — At minimum, waste covering the items defined as 'Covered Devices' in the PA Covered Device Recycling Act (CDRA), to include desktop and laptop computers, computer monitors, computer peripherals, and televisions. Covered devices are prohibited from being placed with Municipal Waste and must be recycled.
HAZARDOUS WASTE - As fully defined in the Solid Waste Management Act, any waste that, because of its quantity, concentration, or physical, chemical, or infectious characteristics may:
   A.   Cause or significantly contribute to an increase in mortality or an increase in morbidity in either an individual or the total population; or
   B.   Pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed of or otherwise managed.
HOUSEHOLD HAZARDOUS WASTE — Portion of municipal waste that would be considered hazardous under the Solid Waste Management Act but for the fact that it is produced in quantities smaller than those regulated as hazardous waste under the Act and is generated by persons not otherwise covered as hazardous waste generators by the Act. Household Hazardous Waste includes the following materials and other materials of a similar nature:
   A.   Anti-freeze;
   B.   Batteries;
   C.   Chlorinated hydrocarbons;
   D.   Fluorescent light bulbs and other mercury-containing devices;
   E.   Gasoline and kerosene;
   F.   Grease and rust solvents;
   G.   Oven, toilet and drain cleaners;
   H.   Paints, rust preventatives, stains and wood preservatives;
   I.   Pesticides, fungicides, herbicides, insecticides, rodenticides, roach and ant killers;
   J.   Photographic and pool chemicals;
   K.   Thinners, solvents and furniture strippers;
   L.   Transmission and brake fluids;
   M.   Used oil or other hydrocarbon based lubricants;
   N.   Wood, metal, rug and upholstery cleaners and polishes.
ILLEGAL DUMPING — The unauthorized depositing, placing, throwing or dumping of solid waste or recyclable materials on public or private property or at any location other than a permitted disposal or processing facility.
LICENSED HAULER — A person or entity licensed by the Commonwealth of Pennsylvania to collect, haul, transport, and dispose of solid waste.
MIXED-USE PROPERTY — A property having both nonresidential and residential units.
MULTI-DWELLING UNITS — All dwelling units in properties housing two or more total dwelling units.
MUNICIPAL COLLECTION — Collection program, under the direction of the City, for the collection, disposal, and processing of municipal waste and designated recyclable materials.
MUNICIPAL ESTABLISHMENT — Public facilities owned or operated by the City of Reading and other government authorities.
MUNICIPAL WASTE — Any garbage, refuse, rubbish, trash, industrial lunchroom or office waste and other material including solid, liquid, semisolid or contained gaseous material resulting from operation of residential, municipal, commercial or institutional establishments and from community activities and any sludge not meeting the definition of residual or hazardous waste hereunder from a municipal, commercial or institutional water supply, treatment plant, waste water treatment plant, or air pollution control facility. The term does not include source separated recyclable materials.
NONRESIDENTIAL UNITS — All commercial, municipal, institutional, and other establishments excluding dwelling units and multi-dwelling units.
PERSON — Any individual, partnership, corporation, association, institution, cooperative enterprise, municipal authority, federal government or agency, state institution and agency, or any other legal entity whatsoever which is recognized by law as being subject to such rights and duties.
PUBLIC RIGHT OF WAY — See § 180-1202 Property Maintenance Rules & Regulations.
RECYCLABLE MATERIAL — Any material which would be municipal waste but, through source separation, can be collected and processed into raw materials or products which are beneficially reused.
RECYCLE — The collection, separation, recovery, and sale or reuse of metals, glass, paper, leaf waste, plastics and other recyclable materials which would otherwise be disposed or processed as municipal waste; or the mechanized separation and treatment of municipal waste (other than through combustion) and creation and recovery of reusable materials (other than a fuel for the operation of energy).
RESIDENTIAL UNITS — For the purpose of this Part, all dwelling units that are deemed part of the City's municipal collection program per section § 496-207 of this Part.
RESIDUAL WASTE — As fully defined in the Solid Waste Management Act, any solid waste, not classified as municipal waste, hazardous waste, or recyclable materials.
ROOMING HOUSE — See Ch. 180 Property Maintenance Code section 202.
ROOMING UNIT — See Ch. 180 Property Maintenance Code section 202.
SCAVENGING — The unauthorized removal of designated recyclable materials from storage and/or collection containers.
SINGLE STREAM — A subset of recyclable materials, including fibers and containers, which are separated from municipal waste but are not separated into individual categories of recyclable materials.
SOLID WASTE — As defined in the Solid Waste Management Act, any waste, including but not limited to, municipal, residual or hazardous wastes, including solid, liquid, semisolid or contained gaseous materials. The term does not include coal ash or drill cuttings.
SOURCE SEPARATE or SOURCE SEPARATION — The separation of recyclable materials from municipal waste at the point of waste generation.
TIRES — For the purposes of this Part, refers to passenger car, van, and light truck tires from non-commercial uses, not to exceed 17" diameter, removed from the rim.
TRASH — See Municipal Waste.
TRASH BAG — Properly tied plastic bags that can hold from 30 to 55 gallons of refuse and have a minimum thickness of 1 mil used to set out municipal waste for collection.
TRASH CAN/DRUM — Any container under 95 gallons, but not less than 30 gallons, with a lid and in any other way differs from a cart.
TRASH RECEPTACLE — All containers used for the storage of trash.
UNITS — Collectively can refer to any of residential units, multi-dwelling units, nonresidential units, or rooming units.
YARD WASTE — Leaves, garden residues, shrubbery and tree trimmings, and similar material, but not including grass clippings.
YARD WASTE BAG — A thirty gallon or equivalent biodegradable Kraft paper bag used for the collection of yard waste.
